Lease terms

Owner pays for PG&E, Trash and Water. Tenant pays for their own internet, SMUD, cable, etc. First months rent and deposit due at signing of lease. Lease is a 1 year term. Pay rent monthly via Zelle. Occupancy Limit The premises shall be occupied only by the approved tenants listed in this Agreement. Maximum occupancy is limited to two (2) residents. Any additional occupant residing at the property for more than fourteen (14) cumulative days within any six-month period shall require prior written approval from Landlord. Guest Policy Guests staying more than seven (7) consecutive nights or fourteen (14) total nights within a six-month period without written approval from Landlord may be considered unauthorized occupants and grounds for lease violation. No Subletting or Short-Term Rentals Tenant shall not sublease, assign, license, or offer any portion of the premises for short-term rental, including but not limited to Airbnb, Vrbo, or similar platforms, without prior written consent from Landlord. Rent Due Date and Late Fees Rent is due on the 1st day of each month. Any rent not received by 5:00 PM on the 3rd calendar day shall incur a late fee of $75 plus $10 per additional day thereafter, not to exceed limits permitted under California law. Acceptance of partial rent shall not waive Landlord's right to pursue the remaining balance owed or enforce lease terms. Returned Payment Fee Any returned check or failed electronic payment shall incur a returned payment fee of $35. Maintenance and Cleanliness Tenant shall maintain the premises in a clean, sanitary, and safe condition and promptly notify Landlord of any maintenance issues, leaks, mold, plumbing problems, or unsafe conditions. Failure to report maintenance issues that result in additional damage may make Tenant financially responsible for resulting repairs caused by negligence or delay in reporting. Alterations Tenant shall not paint, install fixtures, mount televisions, replace locks, install satellite dishes, or make alterations to the premises without prior written consent from Landlord. Smoking Policy Smoking or vaping of any substance is prohibited inside the unit and within twenty (20) feet of doors and windows. Quiet Enjoyment / Nuisance Tenant agrees not to disturb neighbors or engage in conduct that creates excessive noise, illegal activity, or nuisance behavior. Repeated disturbances may constitute grounds for termination of tenancy. Renter's Insurance Requirement Tenant shall maintain renter's insurance throughout the tenancy with minimum liability coverage of $100,000 and provide proof of coverage upon request. Landlord's insurance does not cover Tenant's personal belongings. Entry Notice Landlord may enter the premises in accordance with California Civil Code Section 1954, including for repairs, inspections, showings, emergencies, or agreed services, with proper notice when required by law. Utilities Tenant is responsible for payment of electricity service through SMUD. Landlord shall provide and pay for gas, water, sewer, and garbage services. Excessive utility usage caused by Tenant negligence or misuse may be charged to Tenant where permitted by law. Parking Any off-street parking provided is a revocable privilege and not guaranteed unless specifically assigned in writing. Tenant shall comply with all City of Sacramento parking regulations and permit requirements. Washer and Dryer Use Shared washer and dryer facilities are provided as a convenience only. Landlord shall not be liable for temporary interruptions, breakdowns, or damage to Tenant property resulting from use of shared laundry facilities. Pest Prevention Tenant shall maintain the premises in a manner that prevents pest infestation, including proper food storage and waste disposal. Tenant may be responsible for pest treatment costs resulting from Tenant housekeeping habits or conduct. Abandonment of Property Any personal property left behind after surrender, abandonment, or eviction shall be handled in accordance with California law. Holdover Tenancy Any holdover after termination of tenancy without Landlord's written consent shall convert to a month-to-month tenancy at 150% of the previous monthly rent, subject to applicable California law. Attorney's Fees In any legal action arising out of this Agreement, the prevailing party shall be entitled to recover reasonable attorney's fees and costs to the extent permitted by California law. Lease Violation Notice Repeated violations of lease terms, including unauthorized occupants, smoking, excessive noise, or failure to maintain the premises, shall constitute material breach of this Agreement.
