PARTIES AND PREMISES This Residential Lease Agreement ("Lease") is between the Landlord and Tenant(s) identified above. Landlord leases to Tenant, and Tenant rents from Landlord, the dwelling, fixtures, attached garage, yard, and other improvements located at the Property. Only the named Tenant(s) and approved occupants may reside at the Property. Approved occupants: [NAMES OF MINOR CHILDREN OR OTHER APPROVED OCCUPANTS, IF ANY]. 2. TERM AND POSSESSION The fixed lease term is one (1) year. Tenant may take possession on the start date only after all required funds have cleared, all signatures are complete, and any required proof of insurance has been delivered. Unless the parties sign a written renewal, Tenant must surrender the Property by 11:59 p.m. on the ending date. Any holdover accepted by Landlord will be month-to-month at a rent set by written notice, subject to Texas law. 3. RENT Tenant will pay monthly rent of $2,000.00 in advance on or before the first day of each month, without demand, deduction, or offset except as permitted by law. LATE CHARGES AND RETURNED PAYMENTS Late fee: If rent remains unpaid after two full days following the due date, Tenant will owe an initial late fee of $________ plus $________ for each additional day, not to exceed a total of $________ for that month. Any late fee must comply with Texas law and be reasonable in relation to Landlord's uncertain damages and costs. Returned payment fee: Tenant will pay $________ for each returned, reversed, or dishonored payment, plus any lawful late fees. Landlord may require certified funds after a returned payment. 5. SECURITY DEPOSIT Tenant will pay a security deposit of $2,000.00 before possession. The deposit secures Tenant's performance and is not advance rent. Landlord may make lawful deductions for unpaid rent, damages beyond normal wear and tear, cleaning needed to restore the Property to the move-in condition, missing property, unpaid charges, and other breaches. Tenant must provide a written forwarding address after surrender. Landlord will return the balance and provide any required itemization within the time required by Texas law. 6. UTILITIES AND OTHER BILLS Tenant is responsible for establishing, maintaining, and timely paying all services and bills for the Property during the lease term, including electricity, water, sewer, natural gas (if applicable), trash, internet, cable, telephone, alarm monitoring, and any other service used by Tenant. Tenant must prevent utility disconnection, frozen pipes, property damage, liens, or penalties. Landlord remains responsible only for charges that Texas law does not permit the parties to shift to Tenant. 7. USE, OCCUPANCY, AND CONDUCT The Property may be used only as a private residence. Tenant will not conduct unlawful activity, create a nuisance, disturb neighbors, damage the Property, or permit conduct that increases insurance risk. No subletting, short-term rental, room rental, assignment, or transfer of occupancy is allowed without Landlord's prior written consent. Tenant will comply with all laws, deed restrictions, HOA rules, and community regulations delivered to Tenant. 8. YARD AND EXTERIOR MAINTENANCE Tenant is responsible, at Tenant's expense, for routine yard and exterior upkeep, including mowing, edging, trimming shrubs, controlling weeds, removing leaves and debris, watering as reasonably needed and permitted, keeping beds orderly, and maintaining the yard in a neat condition consistent with neighborhood and HOA standards. Tenant must not remove trees, alter landscaping, install structures, or perform major pruning without written approval. Landlord remains responsible for structural repairs, hazardous tree conditions not caused by Tenant, and obligations that cannot lawfully be shifted to Tenant. If Tenant fails to perform routine yard care after written notice and a reasonable opportunity to cure, Landlord may arrange service and charge Tenant the actual reasonable cost as additional rent to the extent permitted by law. 9. REPAIRS, CONDITIONS, AND REPORTING Tenant has inspected or will inspect the Property and must promptly report leaks, plumbing stoppages, roof or water intrusion, electrical problems, mold or moisture, pest activity, broken locks, smoke-alarm issues, HVAC problems, and other conditions that may cause injury or property damage. Tenant may not withhold rent or repair and deduct except as expressly authorized by Texas law. Tenant is responsible for damage caused by Tenant, occupants, guests, pets, negligence, misuse, or failure to report a problem promptly. 10. LANDLORD ACCESS Landlord, Landlord's agents, contractors, and prospective purchasers, lenders, insurers, or tenants may enter at reasonable times for inspections, repairs, maintenance, appraisals, showings, emergencies, suspected abandonment, or other lawful purposes. Except for emergencies or when impracticable, Landlord will provide reasonable advance notice. Tenant will not unreasonably deny access. 11. SMOKE ALARMS, SECURITY DEVICES, AND SAFETY Landlord will provide smoke alarms and required security devices as required by Texas law. Tenant must test alarms periodically, replace ordinary batteries when needed unless prohibited by law, promptly report malfunctions in writing, and never disable or remove an alarm or security device. Tenant will use reasonable care with grills, candles, heaters, appliances, and other fire hazards. Carbon-monoxide alarms, if installed, must be treated in the same manner. 12. NO SMOKING OR VAPING Smoking, vaping, burning tobacco, marijuana, or any other substance is strictly prohibited inside the dwelling, garage, and all enclosed structures. Tenant is responsible for violations by occupants and guests and for all resulting odors, stains, residue, remediation, damage, or increased cleaning costs. This restriction does not authorize any activity prohibited by law or HOA rules. 13. PARKING AND VEHICLES Only operable, registered, and insured vehicles may be parked in permitted areas. No vehicle repair, fluid draining, long-term storage, commercial vehicle parking, or parking on grass is allowed except with written approval and in compliance with HOA rules. Tenant is responsible for oil, fluid, tire, or other vehicle-related damage. 14. ALTERATIONS, LOCKS, AND FIXTURES Tenant may not paint, remodel, mount televisions, install satellite equipment, change locks, add smart-home devices, alter wiring or plumbing, or make other alterations without prior written consent. Approved improvements become part of the Property unless Landlord requires removal and restoration. Tenant must provide Landlord with working keys, codes, and access credentials for any approved lock or device. 15. INSURANCE AND PERSONAL PROPERTY Landlord's insurance does not cover Tenant's personal property, relocation expenses, or personal liability. Tenant is strongly encouraged and may be required to maintain renter's insurance with at least $________ in personal-liability coverage throughout the lease and to provide proof upon request. Landlord is not responsible for loss of Tenant's property except to the extent imposed by law. 16. PETS AND ASSISTANCE ANIMALS No animal may be kept at the Property unless Landlord first gives written approval and the animal is listed below. Approved pets are subject to all written restrictions and charges. Assistance animals are not pets and will be handled in accordance with applicable fair-housing law; no pet deposit or pet rent will be charged for an approved assistance animal, although Tenant remains responsible for animal-caused damage. CLEANLINESS, PESTS, AND WASTE Tenant will keep the Property sanitary, dispose of trash properly, use plumbing and appliances reasonably, and take ordinary measures to prevent pests. Tenant is responsible for pest treatment necessitated by Tenant's conduct, pets, food storage, or sanitation, but not for conditions for which Landlord is legally responsible. No hazardous, flammable, or illegal materials may be stored at the Property. 18. MOVE-IN CONDITION AND INVENTORY Tenant will complete and return a written move-in condition form within ______ days after possession. Failure to return the form does not waive rights that cannot be waived by law, but may affect proof of pre-existing conditions. Photographs should be dated and retained by both parties. DEFAULT AND REMEDIES Tenant is in default for failure to pay rent or other lawful charges, unauthorized occupants or animals, prohibited smoking, material property damage, criminal activity, abandonment, denial of lawful access, or other material breach. Landlord may deliver notices, terminate possession, pursue eviction, recover damages, and exercise other remedies only as permitted by the Lease and Texas law. Landlord's acceptance of partial payment or delay does not waive future enforcement unless agreed in writing. 20. EARLY TERMINATION AND RELETTING Tenant remains responsible for rent and other charges through the lease term unless released in writing or otherwise provided by law. If Tenant vacates early, Landlord will make reasonable efforts to mitigate damages as required by Texas law. Tenant may owe unpaid rent, lawful reletting costs, cleaning, repairs, utilities, and other actual damages, subject to applicable law. Statutory termination rights, including certain rights related to military service, family violence, sexual offenses, stalking, or other protected circumstances, are not waived. 21. MOVE-OUT AND SURRENDER At move-out, Tenant will remove all persons and property, clean the dwelling and appliances, return all keys and access devices, remove trash, restore unauthorized alterations, complete required yard care, and provide Landlord a written forwarding address. Property left behind may be handled as permitted by Texas law. Surrender occurs only when all occupants have vacated and Landlord has received all keys or otherwise accepted possession. 22. NOTICES Notices must be written and delivered by a method permitted by this Lease and applicable law. Landlord notice address: [ADDRESS, EMAIL IF AGREED]. Tenant notice address during the lease is the Property unless Tenant designates another address in writing. Email or text may be used for routine communication but does not replace a legally required method of notice unless law and the parties' written agreement permit it. 23. HOA AND COMMUNITY RULES Tenant acknowledges that the Property may be subject to Westbourne subdivision or homeowners-association restrictions. Tenant will comply with all rules provided by Landlord, including parking, trash-container, yard, noise, pool, and exterior-appearance requirements. Tenant is responsible for fines or charges caused by Tenant, occupants, guests, or pets, after Landlord provides reasonable documentation. 24. FAIR HOUSING AND NONDISCRIMINATION The parties intend that this Lease be administered in compliance with federal, state, and local fair-housing requirements. Nothing in this Lease authorizes discrimination or waives a right that cannot legally be waived. 25. MISCELLANEOUS This Lease and its signed addenda are the entire agreement. Changes must be written and signed by the parties. If a provision is unenforceable, the remainder remains effective to the extent allowed by law. Texas law governs. Headings are for convenience only. Electronic and counterpart signatures are permitted to the extent allowed by law. No oral promise is binding unless included in a signed writing.
