House Tenant Maintenance, Cleanliness, Utilities, and Enforcement 1. Tenant Maintenance Obligations Pursuant to California Civil Code 1941.2, Tenant shall: (a) Keep the Premises, including all exterior areas under Tenant's control, in a clean and sanitary condition; (b) Properly dispose of all garbage, rubbish, and waste in a clean and sanitary manner; (c) Use and operate all fixtures, appliances, and utilities in a reasonable manner; and (d) Not willfully or negligently destroy, deface, damage, impair, or remove any part of the Premises. 2. Yard and Exterior Upkeep To the extent the Premises include exclusive-use outdoor areas, Tenant shall maintain such areas in a neat, safe, and well-maintained condition, including routine lawn care (mowing, watering, trimming), removal of debris, and prevention of overgrowth. This obligation excludes structural repairs, irrigation system repairs, or replacement of landscaping, which remain Landlord's responsibility except as permitted by law. 3. Cleanliness and Pest Prevention Tenant shall maintain the Premises in a manner that does not create conditions conducive to infestation. Tenant shall be responsible for pest control costs to the extent any infestation is caused by Tenant's failure to comply with Civil Code 1941.2. 4. Safety and Notice of Conditions Tenant shall maintain the Premises in a manner that does not create unreasonable safety hazards and shall promptly notify Landlord of any condition requiring repair that may affect health or safety. Nothing herein relieves Landlord of obligations under Civil Code 1941.1 or applicable habitability laws. 5. Utilities Tenant shall be responsible for payment of all utilities and services serving the Premises, including but not limited to electricity, gas, water, sewer, and trash, except as otherwise required by law or expressly provided in this Agreement. 6. Enforcement; Notice to Cure; Cost Recovery (a) Notice to Perform or Quit: Failure to comply with the obligations set forth in this section shall constitute a material breach of the Lease. Landlord may serve Tenant with a written 3-Day Notice to Perform Covenants or Quit in accordance with California Code of Civil Procedure 1161(3), specifying the noncompliance and required corrective action. (b) Right to Cure and Charge: If Tenant fails to cure the noncompliance within the applicable notice period, or sooner in the event of an emergency or condition posing an immediate risk to health or safety, Landlord may, to the extent permitted by law, enter the Premises in accordance with Civil Code 1954 and perform the necessary maintenance, cleaning, or remediation. Tenant shall reimburse Landlord for the reasonable and actual cost thereof, which may be treated as additional rent to the extent allowed by law. (c) Recurring Services: If Tenant repeatedly fails to maintain the yard, cleanliness, or other obligations after written notice, Landlord may, upon additional written notice, arrange for ongoing maintenance or cleaning services, and Tenant shall be responsible for the reasonable cost as additional rent, to the extent permitted by law. (d) Utilities Default: Failure to maintain required utility service due to nonpayment may be deemed a breach affecting habitability and shall constitute grounds for notice to perform or quit, subject to applicable law. (e) No Waiver of Habitability: Enforcement of Tenant's obligations under this section shall not waive or diminish Landlord's non-delegable duty to maintain the Premises in a habitable condition under California Civil Code 1941.1, nor permit Landlord to recover costs that are the Landlord's legal responsibility. 7. Noise and Compliance with Local Ordinances (Bakersfield, California) (a) General Prohibition Tenant shall not make, permit, or allow any loud, unnecessary, or unreasonable noise that disturbs the peace and quiet of neighboring properties. Pursuant to Chapter 9.22 of the Bakersfield Municipal Code, it is unlawful to create or allow noise that causes discomfort or annoyance to persons within the surrounding area. (b) Quiet Hours Tenant shall comply with local "quiet hours," generally recognized as between 10:00 p.m. and 7:00 a.m., during which stricter noise standards apply. Tenant shall ensure that noise, including but not limited to music, gatherings, or equipment, is not audible beyond the Premises in a manner that disturbs others during these hours. (c) Amplified Sound and Gatherings Tenant shall not use or permit the use of amplified sound (including speakers, DJs, or similar equipment) in a manner that is unreasonably loud, audible beyond the property boundary, or otherwise constitutes a nuisance. Tenant acknowledges that certain amplified sound may require permits and is subject to time restrictions under local law. (d) Construction and Equipment Noise Tenant shall not conduct or permit construction, repairs, or use of motorized landscaping or similar equipment outside of permitted hours, generally limited to: (e) Responsibility and Enforcement Any violation of applicable noise ordinances or this section shall constitute a material breach of the Lease. Repeated complaints, citations, or violations may result in: Service of a 3-Day Notice to Perform or Quit pursuant to California Code of Civil Procedure 1161(3); Liability for fines, penalties, or enforcement costs incurred as a result of Tenant's conduct; and Reimbursement to Landlord for any damages or disturbances caused to other occupants or neighbors, to the extent permitted by law. (f) No Waiver of Legal Standards This provision is intended to mirror applicable local law. In the event of any conflict, the stricter standard between this Lease and applicable law shall apply. Landlord may provide certain appliances on the Premises, including but not limited to refrigerator, stove/oven, dishwasher, and washer/dryer, if any. Except for appliances required to maintain habitability under California Civil Code 1941.1, all appliances are provided for Tenant's convenience. Unless otherwise required by law or expressly stated in this Agreement: (a) Tenant shall use all appliances in a reasonable manner and in accordance with manufacturer guidelines; (b) Tenant shall be responsible for routine cleaning and maintenance; (c) Tenant shall be responsible for the cost of repair or replacement of any appliance damaged due to misuse, negligence, or failure to properly maintain; and (d) Landlord shall be responsible for repair or replacement of appliances due to normal wear and tear, unless the appliance is expressly designated in this Agreement as provided "as-is" without maintenance obligation. Any appliance designated as "as-is" is not guaranteed to be repaired or replaced by Landlord, to the extent permitted by California law. Additional details to be added in final lease agreement.
