Lease terms

Lease term and move-in costs: A 12-month lease is required. Monthly rent is $2,350. A security deposit equal to one month's rent is required. First month's rent and all applicable deposits must be paid before possession is delivered. Renters insurance with at least $100,000 in personal-liability coverage must remain active throughout the tenancy, with proof required before move-in and upon renewal. Occupants and guests: The home may be occupied only by the persons specifically identified and approved in the lease. Every person 18 years of age or older who will reside at the property must complete an application, satisfy the rental criteria and sign the lease before moving into the home. Household-composition changes must be reported promptly and will be handled in accordance with applicable fair-housing and occupancy laws. Guests may not stay more than seven consecutive nights or more than 14 total nights during any 60-day period without the landlord's prior written approval. A person may be treated as an unauthorized occupant when the circumstances show that the person is residing at the property, including regular overnight stays, possession of a key or access code, keeping substantial personal belongings at the home, or using the property as a primary residence. No subletting, room rentals, assignment of the lease, short-term rentals or unauthorized occupants are permitted. Unauthorized occupancy, failure to disclose an additional resident or allowing an unapproved adult to reside at the property constitutes a material lease violation. Utilities and solar: Tenant is responsible for electricity, natural gas, water, sewer, trash, internet and cable. HOA dues, garage and driveway parking, available community amenities and use of the existing solar-panel system are included without an additional monthly charge. Solar production and electricity savings vary according to weather, usage, utility rates and the tenant's electricity plan and are not guaranteed. Tenant may not alter, disconnect, damage or perform work on the solar equipment. Lawn and landscaping: Landlord will provide routine professional mowing and edging. Tenant is responsible for reasonable watering of the lawn, trees, shrubs and planting beds in compliance with current governmental watering restrictions; controlling pet waste; preventing digging and excessive turf damage; keeping the yard free of trash and debris; and promptly reporting broken sprinkler heads, leaks, drainage problems, diseased vegetation or irrigation-system malfunctions. Tenant may not remove, relocate, cut down or materially prune any tree, shrub or established plant; modify planting beds; install a garden; apply vegetation-killing chemicals; or alter the irrigation system without prior written approval. Tenant is responsible for documented restoration costs resulting from neglect, failure to water when legally permitted, pet urine or digging, vehicle damage, unauthorized landscaping, removal of plants or other damage beyond normal seasonal wear. Normal drought-related or seasonal dormancy that is not caused or worsened by tenant neglect will not be treated as tenant damage. Pools and outdoor equipment: Above-ground pools, inflatable pools, hot tubs, water-filled recreational structures, trampolines, playsets, sheds, fire pits and other equipment capable of damaging the grass, irrigation system, fence or landscaping are prohibited unless the landlord gives prior written approval. Tenant is responsible for restoring any lawn, landscaping, irrigation or structural damage caused by approved or unauthorized outdoor equipment. Pets: A maximum of two specifically approved household pets is permitted, subject to the pet agreement, applicable deposits and monthly pet rent. No additional or replacement animal may be kept at the property without prior written approval. Tenant is responsible for immediately removing animal waste, controlling fleas and odors, repairing holes and preventing damage to doors, flooring, fencing, landscaping and irrigation equipment. Pet deposits do not limit the tenant's responsibility for actual animal-related damage. Assistance animals are not pets and will be addressed separately under applicable law. HOA requirements: Tenant, occupants, guests, pets and vehicles must comply with all HOA declarations, rules, parking restrictions and community policies provided to the tenant. Landlord pays regular HOA dues. Tenant is responsible for documented HOA fines, enforcement charges and related costs caused by the tenant, occupants, guests, pets or vehicles. Tenant must correct violations by the deadline in the notice and reimburse the landlord within 10 days after receiving documentation. Repeated violations, failure to correct a violation or failure to reimburse documented charges constitute lease violations and may result in nonrenewal or other lawful remedies. Property care and alterations: No smoking or vaping is permitted inside the home or garage. Tenant may not paint, install fixtures, drill into tile or exterior surfaces, change locks, modify wiring or plumbing, or make permanent alterations without written approval. Tenant must replace HVAC filters at least every 60 days, use plumbing fixtures properly, maintain reasonable cleanliness and promptly report leaks, water intrusion, electrical problems, HVAC failures, roof damage, pest infestations and other conditions that could worsen if not reported. Parking and use: Vehicles must be parked only in the garage, driveway or other lawful HOA-approved locations. Parking on the grass, blocking sidewalks, storing inoperable vehicles or performing major vehicle repairs at the property is prohibited. The property may not be used for unlawful activity, commercial storage or a business that creates customer traffic, excessive noise, parking problems, insurance concerns or HOA violations. Inspections and enforcement: The landlord may conduct reasonable periodic interior and exterior inspections, generally with at least 24 hours' notice, except in emergencies or other circumstances permitted by the lease and law. The landlord may reinspect after giving notice of a maintenance, pet, occupancy, HOA or landscaping violation. Failure to correct a material violation may result in charges for actual documented damage, nonrenewal or termination through the process permitted by the lease and Texas law. Screening criteria: Written tenant-selection criteria will be provided when the rental application is made available. Criteria may include current income, credit history, previous rental history, criminal history and the accuracy and completeness of information supplied. All applicants will be evaluated consistently under the published criteria.
