Terms at 1724 E Loma Vista St

1. Late Fees, Eviction Administrative Fees, and Early Termination Rent Default and Fees: Tenant agrees to pay a $15/day fee starting the 4th day the monthly rent becomes late until rent is paid in full to the current date. Any Lease in the eviction process will be charged an additional Administrative fee of $350.00. Early Termination: An Early Termination Fee of Three Months' rent will be charged if the lease does not go to full term. Written 60-day notice of vacating is required at the beginning of the last full month of the contract. 2. Tenant Liability, Indemnification, and Renter's Insurance Risk of Loss: The Tenant acknowledges and agrees that the risk of loss for all contents and property belonging to the Tenant shall be on the Tenant. The Landlord is not an insurer of the Tenant's property. The Tenant is required to obtain and keep current his/her own renter's insurance policy ($100K limit of liability) against fire, theft, or other disasters, as the Landlord carries insurance on the building only. Tenant is encouraged to ensure this policy covers any losses or liability that may result from the actions of a pet. Indemnification: The Tenant hereby agrees to indemnify, compensate, and forever hold harmless the Landlord, its successors and assigns, any parent affiliate and subsidiary entities, their insurers, their assigns, their successors, their legal representatives, officers, directors, employees, agents, or any others who may be acting on behalf of them from any and all claims, damages, actions, causes of action, or liability whatsoever (including attorney's fees), resulting from or arising out of: Injury to or death of any guest, agent, employee, licensee, or invitee of the Tenant in or about the Premises, or damage or destruction of any property owned by the Tenant or any guest, agent, employee, licensee, or invitee of the Tenant, unless such injury, death, or damage solely and directly results from the intentional or grossly negligent acts of the Landlord. The negligent or intentional acts of the Tenant's pet or their guests' pet. Tenant may be held liable for failing to comply with this pet provision. Landlord and its agents shall not be liable to Tenant, their guests, or any third parties for any harm as a result of any pet issue other than for the intentional acts of the Landlord. 3. Smoking Restrictions (Cigarettes, Vapes, and Marijuana) Smoking Prohibitions and Penalties: Lessee agrees that there shall be no smoking or vaping of tobacco, cigarettes, cigars, e-cigarettes, vapes, or marijuana (including medical or recreational marijuana, whether smoked, vaped, or atomized) inside the property or any enclosed areas of the premises. Lessee agrees to pay a fine of $500 for each violation. Any damage caused by Lessee smoking in the property will be Lessee's responsibility at the time the fine is issued this includes, but is not limited to, professional smoking odor removal, air filtration, deep cleaning, and repainting. 4. Pet Rules, Restrictions, and Landlord Right of Entry Obligations of the Tenant Regarding Pets: Tenant agrees to take reasonable steps to control and care for their pet at all times. They further agree to prevent and report any signs of pet damage within two days. Notification of damage shall constitute Tenant's permission for the Landlord to enter the unit to inspect. Tenant agrees to keep the home in a clean and debris-free condition and to remove all feces in a timely manner. Tenant agrees to pay for any treatments to the home (including professional carpet cleaning, tick, or flea remediation) that are required as a result of their pet living on the premises. Tenant is fully liable for all behaviors of their pet and may be evicted as a result of any disruptive or dangerous activity involving their pet. Pet Containment and Landlord Access: Tenant agrees to safely contain the pet while the Landlord or its agents are on the premises for any work that needs to be completed, when the property is being shown, or for any other reason that permits the Landlord access to the premises pursuant to ARS 33-1343. Pet Rules and Compliance: Tenant agrees to comply with all state, city, federal, or other governmental entity rules, laws, or regulations that govern animals, including but not limited to pet registration, licensing, and limitations on the type or number of animals allowed on the premises. Tenant agrees to keep all animals, other than dogs and cats, in appropriate cages at all times. Pet Restrictions: The Landlord has the right to restrict the breed, size, or species of the pet permitted on the premises (validated Service and Emotional Support Animals excepted). The Landlord may withdraw permission for the pet to live on the premises at any time based on reasonable standards involving the conduct of the pet or the Tenant. Currently prohibited pets include fish, reptiles, rabbits, vermin/rodents, pigs, fowl, livestock, and non-domesticated animals. Landlord may impose or modify rules and regulations involving pets with a 30-day written notice to the Tenant, and those rules will become a fully enforceable part of this lease, including but not limited to the imposition of fines and the requirement for the Tenant to provide and pay for DNA testing of the pet (for waste enforcement). Removal of Pet and Emergency Medical Care: Tenant agrees to properly care for their pets and remove them when the lease has ended. If the Tenant fails to promptly remove the pet within 24 hours of the termination of the lease and return of possession (through any legal means), Tenant agrees that Landlord shall have the right to remove the pet and make alternative arrangements for that pet's care at the Tenant's sole expense. If the Landlord determines that a pet must be removed because of behavioral issues, Tenant agrees to remove the animal immediately if the incident involves a health or safety concern, and not later than 10 days for any other reason. The Tenant agrees that the Landlord may enter the apartment without notice if they reasonably believe the animal is in distress, injured, in need of medical care, or abandoned. If the animal is determined to need medical care, the Landlord may remove the animal immediately and seek veterinary attention. The Tenant is solely liable for any and all medical or boarding costs. The Tenant releases the Landlord from any liability or harm caused to the animal in meeting these obligations, unless said actions by the Landlord are deliberate and intentionally malicious. The decision to enter, remove the animal, or seek medical care remains at the Landlord's sole discretion.
