Lease terms

1. TERM. The OWNER rents to the HOUSE TENANT the described premises, for an unspecified month-to-month agreement beginning on _________________, until terminated by either party with no less than 30 days' notice. 2. RENT. The total rent for each month is the sum of EIGHT HUNDRED & SEVENTY-FIVE DOLLARS ($875). Unless there is some other written arrangement signed by both parties, all such payments shall be made to the OWNER, on or before the Twenty-fifth (25th) of each month and without demand. 3. DAMAGE DEPOSIT DAMAGE DEPOSIT is the sum of EIGHT HUNDRED & SEVENTY-FIVE DOLLARS ($875). The DAMAGE DEPOSIT ($875) is held as security for the repair and restoration of the HOUSE properties at 1644 Landes St. to the condition at the date and time of first occupancy in mid-September 2025 above and beyond normal wear and tear. If it is necessary for the OWNER to make repairs to said property after the HOUSE TENANT vacates 1644 Landes St. then the OWNER will subtract labor plus material expenses from said security deposit after assessments are complete. The damage deposit shall be returned to HOUSE TENANT, without interest, and less any set off for damages to the premises within 30 days from the date the renter vacates property. 4. CLEANING FEE. CLEANING FEE in the amount of TWO HUNDRED DOLLARS ($200) is to be paid IN FULL with the first month's rent. This is a non-refundable CLEANING FEE. 5. INITIAL DEPOSIT. CLEANING FEE and FIRST MONTH's (PRO-RATED, if necessary) RENT, a total of ONE THOUSAND AND SEVENTY-FIVE DOLLARS ($1075) will serve as an initial deposit paid IN FULL before moving in. 6. LEASE TERMS: month-to-month agreement beginning at occupancy and terminated by either party with no less than 30 days' notice. 7. RENTER'S INSURANCE. The TENANT is advised to acquire and retain proof of renters insurance at a level of $100,000 liability coverage. 8. USE OF PREMISES. The Premises shall be used by and for dwelling purposes. 9. CONDITION OF PREMISES. Photos of the premises or walk through report by the OWNER, TENANT and/or other representatives shall provide a record of the condition of buildings at the time of occupancy. The condition of yard and house are to be kept to this standard or better during rental period and in the same condition before deposit is returned if either premise is vacated. 10. ASSIGNMENT AND SUB-LETTING. Other persons living on the premises require notification and consent of the OWNER, landlord. 11. LANDLORD'S RIGHT OF TERMINATION. If the TENANT fail to pay rent or other charges promptly when due, or comply with any other term of this agreement, landlord, after proper written notice, may terminate this tenancy. 12. TENANTS TO KEEP PREMISES CLEAN. The TENANT shall maintain the premises in a clean and sanitary condition at all times, and upon the termination of the tenancy shall surrender it to landlord in as good condition as when received. Ordinary wear and tear and damage by the elements excepted. 13. COMMUNICATION ABOUT LANDES PROPERTY: TIME IS OF THE ESSENCE. As the TENANT agrees to notify Anna Bachmann, the OWNER, in person, by email or phone; or other designated representatives of damages, changes or problems in a timely manner. This shall be done with the intent to avoid or avert a danger or a crisis if at all possible. 14. RESPONSIBILITY TO MAINTAIN GROUNDS. The TENANT agrees to participate in making sure that yard is in good appearance by mowing, adequately watering the garden, and grounds and keeping shrubbery trimmed from touching buildings on the property. Tools and lawnmower will be properly cared for and replaced in shed or under cover when not in use. 15. LANDLORDS' OBLIGATIONS. Landlord shall maintain all appliances supplied by the landlord in reasonable good working order and provide assistance if necessary in discussing maintenance issues. Good communication is the standard for all involved parties. 16. LANDLORD OR AGENT: RIGHT OF ENTRY. Except in the case of emergency, or if it is impracticable to do so, the TENANT shall have one day (24 hours) notice of intent to enter. To permit landlord or her agents and representatives at reasonable times to enter for the purpose of inspection their condition, or to make necessary or agreed repairs, alterations or improvements, supply necessary or agreed services, or exhibit the premises or assist prospective or actual tenants, workers, or contractors; provided always that the landlord may enter the premises without consent of tenant in case of emergency or abandonment. Landlord shall further have the right to exhibit the Premises and to display the usual "for rent" or "vacancy" signs on the Premises at any time within thirty (30) days before the expiration of this Lease. The right of entry shall likewise exist for the purpose of removing signs, fixtures, alterations or additions. 17. LOCKS AND KEYS. OWNER or her representatives shall provide reasonable, adequate locks on outside doors, and furnish a key to TENANT. The TENANT will pay for any replacement costs for a lost key. 18. UTILITIES. Utilities (including water, garbage, and WIFI) are covered except for the power bill and firewood. The latter should be purchased jointly with the owner before each fall (roughly 1 1/2 cords of wood). In addition to the wood stove, heat is provided by a programmable baseboard heater. 19. SMOKE DETECTOR AND FIRE ALARM SAFETY. Smoke Detectors and Carbon Monoxide Alarms are provided and will be kept in good operation condition by the TENANT. 20. ALTERATIONS AND IMPROVEMENTS. No changes to grounds or house shall be made without clear communication by email or notification by TENANT to the landlord or her agent. 21. DAMAGE TO PREMISES. In the event the Premises are destroyed or rendered wholly untenantable by fire, storm, earthquake, or other casualty not caused by the negligence of landlord, this Agreement shall terminate, and rent shall be prorated and refunds made accordingly to the TENANT. 22. HOLD OVER. If the TENANT remains in possession of the Premises with the express consent of Anna S. Bachmann, the TENANT and/or representative after the natural expiration of this Agreement, a new agreement from month-to-month shall be created between both parties, except that such tenancy shall be terminable upon thirty (30) days written notice served by either party. 23. SURRENDER OF PREMISES. Upon the expiration of the term hereof, the TENANT shall surrender the Premises in as good a state of and condition as they were at the commencement of this Agreement, reasonable use and wear and tear thereof and damages by the elements excepted. 24. PET POLICY. No pet deposit is required but the TENANT is expected to control their pet on the property and will be responsible for any damage, conflicts and/or injuries caused by their pet to other TENANT/PETS on the property or to surrounding neighbors. 25. SMOKING. The agreement is there will be no smoking within the INTERIOR OF THE HOUSE. 26. QUIET ENJOYMENT. Upon payment of all of the sums referred to herein the TENANT will be allowed quiet enjoyment of this property in and around 1644/1646 Landes Street. 27. INDEMNIFICATION. The OWNER shall not be liable for any damage or injury of or to the TENANT, his family, guests, invitees, agents or employees or to any person entering the Premises or the buildings of which the Premises are a part or to goods or equipment, or in the structure or equipment of the structure of which the Premises are a part. The TENANT hereby agrees to indemnify, defend and hold the OWNER harmless from any and all claims or assertions of every kind and nature. 28. DEFAULT. If the TENANT fails to comply with any of the material provisions of this Agreement, the OWNER, her agent or representative specified by her may terminate this Agreement. If any unlawful activity is suspected, the landlord may have the police investigate and take legal action against those involved. 29. LATE CHARGE. In the event that any payment required to be paid by the TENANT hereunder is not made within 7 (seven) days of when due, renter shall pay to landlord, in addition to such payment or other charges due hereunder, a "late fee" in the amount of FIVE DOLLARS ($5) per day may be assessed in addition to the agreed monthly rental payment. 30. WRITTEN NOTICES. Written notices may be made personally, by email or postal service. The date of posting constitutes the date of notice. 31. PERSONAL PROPERTY. Any personal property remaining after renter moves will be disposed of and the cost of removal will be included in services for damages. 32. LEAD BASED PAINT. This house has not been tested for toxic substances but was built in 1932. The OWNER shall be held harmless for lead-based paint hazards. 33. INDOOR MOLD. The TENANT agrees to maintain the premises to prevent indoor mold from becoming a problem. 34. ATTORNEYS' FEES. Should it become necessary for an attorney to be involved in enforcing any of the conditions or covenants hereof, including the collection of rentals or gaining possession of the Premises, the TENANT agrees to pay all expenses so incurred, including a reasonable attorneys' fee. 35. GOVERNING LAW. This Agreement shall be governed, construed and interpreted by, through and under the Laws of the State of Washington. 36. SEVERABILITY. If any provision of this Agreement or the application thereof shall, for any reason and to any extent, be invalid or unenforceable, neither the remainder of this Agreement nor the application of the provision to other persons, entities or circumstances shall be affected thereby but instead shall be enforced to the maximum extent permitted by law. 37. MODIFICATION. The parties hereby agree that this document contains the entire agreement between the parties, and this Agreement shall not be modified, changed, altered or amended in any way except through a written amendment signed by all of the parties hereto.

WHAT'S IT LIKE A private room available in a shared 2-bedroom, 1-bath house. Small closet space in room plus additional shared closet space. Views of Kai Tai Lagoon and garden. Shared living room, kitchen, mudroom, bathroom (actual room for rent has a new floor). Short walk to Safeway and Haines Park and Ride. Separate studio on property already has single occupant. Limited storage. Pets ok. No smoking in the house. Heat is wood stove and baseboard. Communal kitchen arrangement with shared staples. Renter must be scrupulously clean, respectful, and conscientious. IMPORTANT NOTE: PLEASE MESSAGE ME AND ANSWER THE QUESTIONS BELOW SO I CAN LEARN MORE ABOUT YOU (I've included a little about myself with each question): 1. Who will be living in this house? Tell me details about yourself. (I'm a 64-yr old woman, politically liberal, Buddhist, enviro-type, originally from the East Coast, living in the Pacific NW since the late 80s, but have lived overseas as well) 2. What kind of work do you do? (I work in Seattle for an environmental group focused on clean water ... I'll be around typically Fridays thru Mondays) 3. What lifestyle do you have? (I'm generally sociable but quiet; don't keep late hours; work from home when I'm there; mostly eat veg, but sometimes enjoy a burger; I x-country ski, do yoga, a little archery, have been known to sail, play on the Drizzle B-ball team; try to meditate daily, watch the occasional flick with my housemate... unlike some people, I actually enjoy living with other like-minded folks and I want to live with folks that have a similar mindset ... if you want to live completely shut up in your room and have no interactions, I'd suggest a different living arrangement) 4. What is your experience with communal households? (Are you ok with sharing staples (aka flour, sugar, oils & spices) and the occasional meal? 5. What are you used to in terms of housekeeping? 6. Are you interested in participating in a shared garden area? (We want to move the garden soon and need some help with it, also some general upkeep around the place ... mowing, weeding, etc. will be a plus) 7. Do you have your own bedroom furniture (the room is currently unfurnished)? 8. Do you need a lot of storage (we are rather limited on space)? 9. It's month to month but are you comfortable making at-least a 6-month commitment? 10. When is your ideal move in date? 11. The room is not suitable for more than 1 person for long-term, but how often would you be having guests over to stay the night?
