Lease terms
The lease term shall be for one (1) year, commencing on the agreed-upon start date and ending on the agreed-upon expiration date. Monthly rent paid electronically on the 1st of each month. Smoking is strictly prohibited anywhere inside the dwelling, garage, basement, and any enclosed areas of the property. This prohibition includes cigarettes, cigars, pipes, e-cigarettes, vaping devices, marijuana, and any other smoking products. Tenant shall be responsible for any costs associated with removing smoke odors or repairing smoke-related damage. No pets shall be permitted on the premise. Unauthorized pets shall constitute a violation of the lease agreement. Tenant shall be responsible for maintaining the lawn and landscaping throughout the lease term, including: Regular mowing of all grass areas, Trimming and edging as needed, Removal and control of weeds in lawn areas, flower beds, landscaping, and around the property, and Disposal of yard waste in accordance with local regulation. Failure to maintain the lawn and landscaping may result in Landlord arranging for service and charging the Tenant for all associated costs. Tenant shall regularly inspect and maintain all window wells. Tenant is responsible for removing leaves, debris, dirt, and any other obstructions from window wells to ensure drains remain clear and functional. Tenant shall promptly notify Landlord of any drainage issues or damage to window wells. Tenant shall be responsible for the prompt removal of snow and ice from all walkways, sidewalks, driveways, steps, patios, and entrances serving the property. Snow shall be removed within twenty-four (24) hours after the end of a snowfall event or sooner if required by local ordinance. Tenant shall NOT apply salt, sand, or other ice-melting materials to concrete driveway, patio, stoops, or sidewalks. Tenant shall be responsible for complying with all applicable municipal snow and ice removal requirements and shall be liable for any fines, citations, or penalties resulting from noncompliance. Any damage to the property resulting from Tenant's failure to remove snow and ice, including but not limited to water intrusion, drainage issues, or slip-and-fall claims arising from Tenant's negligence, shall be the responsibility of the Tenant. If Tenant fails to adequately remove snow or ice, Landlord may arrange for snow removal services and charge the Tenant for all associated costs, which shall be considered additional rent due under the lease. Tenant shall be responsible for all utilities serving the property, including but not limited to: Electricity, Natural gas, Water/Sewer, Trash and recycling services, Internet, cable, and telephone services. Tenant shall place all applicable utility accounts in their name prior to or upon occupancy and maintain uninterrupted service throughout the lease term. Tenant shall replace the HVAC/furnace air filter at least once every three (3) months during the lease term. Tenant shall use filters of the appropriate size and specifications for the system. Failure to replace filters as required may result in Tenant being responsible for maintenance or repair costs arising from neglect. Tenant shall keep the premises clean, sanitary, and in good condition. Tenant shall promptly report any maintenance issues, leaks, drainage concerns, or system malfunctions to the Landlord. Tenant shall be responsible for damages caused by negligence, misuse, or failure to perform the responsibilities outlined in this lease. A maximum of two (2) vehicles may be regularly kept, parked, or stored on the property at any time unless otherwise approved in writing by the Landlord. All vehicles must be properly licensed, registered, and operational. Parking shall be limited to designated driveway and garage areas. Parking on lawns or landscaped areas is prohibited. Tenant shall not permit abandoned, inoperable, or unregistered vehicles to remain on the property. The maximum number of occupants residing at the property shall not exceed five (5) persons. Any person residing at the property for more than fourteen (14) consecutive days or more than thirty (30) days in any twelve-month period shall be considered an occupant and must be approved by the Landlord. Tenant shall not permit occupancy in excess of the maximum occupancy limit without the Landlord's prior written consent. Violation of the occupancy limit shall constitute a material breach of the lease agreement. Rent shall be due on the 1st day of each month. If rent is not received by the due date, Tenant shall be considered in default under the lease. Any late fees shall be assessed as outlined in this Lease and in accordance with applicable Illinois law. Failure to pay rent when due may result in the Landlord serving the required legal notices and pursuing eviction proceedings as permitted by law. Acceptance of a partial rent payment does not waive the Landlord's right to pursue collection of any remaining balance or enforce the lease terms. Tenant shall maintain all required utility accounts in Tenant's name throughout the lease term. Failure to maintain utility service due to nonpayment shall constitute a lease violation. Tenant shall be responsible for any fees, damages, frozen pipes, service interruptions, or other losses resulting from utility disconnection. Landlord may issue notice to cure the violation or pursue other remedies available under the lease and applicable law. Only individuals listed on the lease application and approved by the Landlord may reside at the property. Guests may not remain on the premises for more than fourteen (14) consecutive days or more than thirty (30) days in any twelve-month period without the Landlord's prior written consent. Any unauthorized occupant shall be considered a lease violation and may result in termination of the lease. Tenant shall not assign this lease, sublease any portion of the property, offer the property for short-term rental, or permit any other person to occupy the premises in exchange for compensation without the Landlord's prior written consent. Listing the property on short-term rental platforms is strictly prohibited. If Tenant vacates or abandons the property before the lease term expires, Tenant shall remain responsible for rent and other obligations under the lease until the property is re-rented or the lease term ends, subject to Illinois law. Tenant shall be responsible for any collection costs, court costs, and reasonable attorney fees incurred by the Landlord in enforcing the lease to the extent permitted by Illinois law. If Tenant remains in possession of the property after the lease expiration date without written authorization from the Landlord, Tenant shall be considered a holdover tenant and may be subject to additional rent, damages, and legal action as permitted by Illinois law.
