1. Lease Term This lease shall be for a period of twelve (12) months, beginning on __________ and ending on __________, unless otherwise terminated in accordance with the terms of this agreement and applicable North Carolina law. 2. Monthly Rent Tenant agrees to pay monthly rent in the amount of $1,995.00. Rent is due on or before the 1st day of each month and shall be paid in the manner designated by the Landlord. 3. Security Deposit Tenant shall pay a security deposit in the amount of $1,995.00 prior to move-in. The security deposit will be held in accordance with North Carolina General Statute 42-50 and may be used for the following: Unpaid rent Late fees Damage beyond normal wear and tear Cleaning costs necessary to restore the property Unpaid utilities Costs associated with breach of lease The security deposit, less any lawful deductions, will be returned within 30 days after termination of tenancy, as required under North Carolina law. 4. Late Fees (North Carolina Compliance) If rent is not received by the 5th day of the month, a late fee will be assessed. The late fee shall be the greater of $15 or 5% of the monthly rent, as permitted under North Carolina law. Late fees are considered additional rent and must be paid promptly. 5. Utilities Tenant is responsible for payment of all utilities and services associated with the property, including but not limited to: Electricity Water and sewer Gas (if applicable) Trash collection Internet / cable Utilities must remain active and in the Tenant's name during the entire lease term. 6. No Smoking or Vaping Smoking or vaping of any kind is strictly prohibited inside the home. This includes cigarettes, cigars, pipes, electronic cigarettes, vape devices, marijuana, or any other smoke-producing substances. Tenant will be responsible for any cleaning, deodorizing, repainting, or repairs required due to smoking or vaping. 7. Routine Maintenance Responsibilities Tenant agrees to maintain the property in a clean and sanitary condition. HVAC Maintenance Tenant shall replace HVAC air filters monthly or quarterly depending on the filter type used to ensure proper operation of the heating and cooling system. Failure to replace filters that results in damage to the system may result in repair charges billed to the Tenant. General Property Care Tenant shall: Maintain cleanliness of the property Promptly report maintenance issues Properly operate appliances and fixtures Prevent mold or mildew caused by neglect 8. Lawn and Exterior Maintenance Tenant is responsible for routine yard maintenance, including: Lawn mowing Weed control Removal of trash or debris Basic upkeep of exterior areas Failure to maintain the yard may result in the Landlord arranging service and billing the Tenant. 9. Plumbing and Drain Care Tenant shall not place grease, wipes, hygiene products, paper towels, or foreign objects into sinks, drains, or toilets. Any plumbing clogs caused by misuse will be the responsibility of the Tenant. 10. Subleasing / Short-Term Rentals Tenant may not sublease the property or use the property for short-term rentals without written permission from the Landlord. This includes platforms such as: Airbnb VRBO Furnished Finder Any similar services 11. Occupancy Only individuals listed on the lease may reside in the property. Guests staying more than 14 consecutive days or more than 30 days in a year must receive written approval from the Landlord. 12. Early Lease Termination If Tenant terminates the lease prior to the expiration of the lease term, Tenant shall remain responsible for: Rent payments until the property is re-rented A lease termination fee equal to one month's rent ($1,995) Tenant must provide at least 30 days written notice. 13. Military Clause (PCS Orders) If Tenant is an active-duty service member and receives Permanent Change of Station (PCS) orders, Tenant may terminate the lease in accordance with the Servicemembers Civil Relief Act (SCRA). Tenant must provide: A written notice A copy of official military orders Termination will take effect 30 days after the next rental payment due date following notice. 14. Professional Cleaning Requirement Tenant agrees to return the property in clean condition comparable to move-in condition, excluding normal wear and tear. Tenant shall ensure the property is professionally cleaned at move-out, including: Floors and carpets Bathrooms Kitchen appliances Cabinets and countertops Cleaning costs may be deducted from the security deposit if necessary. 15. Default and Non-Payment of Rent If rent is not paid as required, Landlord may issue a 10-Day Notice to Pay Rent or Quit as permitted under North Carolina law. Failure to cure the default may result in eviction proceedings. 16. Property Condition Tenant acknowledges that the property has been inspected and accepted in good condition except for items noted in the Move-In Inspection Report. Tenant agrees to return the property in substantially the same condition, excluding normal wear and tear.
