Noblesville Residential lease! 1. Premises: 15223 Follow Drive, Noblesville, IN 46060. This premises was built in 1999. The latest closing date was January 19, 2024, with all valid documents. I am unsure of the exact date, but the previous owner painted the inside and outside before selling. The current lessor only repainted the scratched areas. 2. Terms: Start date; Duration: at least 12 months; End date: Security deposit: $2700Rent amount $2200Rent due on: first date of the month; Late fee: $40 No pets. 3. Leaser: 4. Lessee: 5. Clause: a- The lessee shall pay to the lessor or lessor's authorized agent, at the address set forth above, or as changed by written notice to the lessee, as rent for the premises or otherwise the sum as stated above. Rent is due and payable in advance on the first day of each calendar month. The timely payment of each installment of rent is deemed to be of the essence of this lease. The failure to pay rent when due may result in the lessor bringing an action in court to recover unpaid rent and/or possession. b- Each lessee is jointly and severally liable for the payment of rent and performance of all other terms of this agreement. c- Lessee has deposited with the lessor, the sum set forth above as a security deposit to secure the faithful performance by the lessee of all provisions in this lease. If the lessee performs all obligations in this lease and pays all sums due to the lessor, then, after the lessee has surrendered possession of the premises and returned the keys to the premises, the lessor shall refund the deposit to the lessee within forty-five (45) days after the termination of occupancy. If the lessee causes damages to the premises, then the lessor may apply the security deposit to repair such damages. The lessor shall provide the tenant an itemized list of damages within forty-five (45) days of the termination of occupancy with the estimated repair cost for each damaged item or fixture, and the amounts that lessor intends to assess lessee. The security deposit shall not be treated as an advance payment of rent, and the lessee shall not apply the security deposit as rent during the lease term unless the lessee obtains written permission from the lessor to do so. d- Lessee shall be permitted to take possession of the premises at the commencement of the lease. If the lessor cannot deliver possession of the premises at the commencement of the lease term, the rent shall be abated until the premises are available for occupancy by the lessee, or the lessee may terminate this lease upon written notice to lessor. The lessor shall not be liable to the lessee for any consequential damages to lessee arising because of the lessor's inability to give the lessee possession of the premises at the commencement of the lease term. e- Lessee has examined the premises before accepting possession and before the execution of this lease. The lessee is satisfied with the physical condition of essential services of the premises, including, but not limited to, electrical systems, sanitary systems, plumbing systems, and heating, ventilation, and air conditioning systems . If any of the essential services of the premises do not operate satisfactorily due to malfunction, the lessee must promptly notify the lessor in writing of such malfunction. The lessee further acknowledges that the premises are equipped with one or more functional smoke detectors, and that it is the lessee's obligation to ensure that each smoke detector remains functional by either replacing the batteries in the smoke detector, or by written notice to lessor requesting evaluation of hard-wired smoke detectors. The lessee's acceptance of possession shall constitute conclusive evidence of the lessee's receipt of the premises in good order and repair as of the commencement of the lease term. The lessor, or its agent, has made no promises as to the condition or the repair of the premises to the lessee unless they are expressed in this lease, or as a rider attached to this lease signed by lessee and lessor, or its agent. No promises to decorate, alter, or repair the premises have been made by the lessor or his agent unless expressed in this lease. f- Except as provided by state or local law or ordinance, the lessor shall not be liable for any damage: occasioned by failure to keep the premises in repair; for any loss or damage to the lessee's property wherever located in or about premises, or acts or neglect of other tenants or occupants or others at the premises. g- Lessee shall keep the premises and the fixtures and appliances of the premises in a clean and healthy condition, and in good working order in accordance with all ordinances applicable to the tenancy, sometimes at the lessee's own expense. Upon the termination of this lease, for any reason, the lessee shall return the premises to the lessor in as good a condition of cleanliness and repair as at the commencement of this lease, reasonable wear and tear excepted. Lessee shall make all necessary repairs to the premises whenever damage has occurred, or repairs are required due to the lessee's conduct or neglect, including replacing all broken glass and fixtures, if applicable. The lessee shall maintain all smoke detectors and carbon monoxide detectors in good condition always, including replacing spent batteries as necessary. Lessee shall notify the lessor immediately in writing if a smoke detector or carbon monoxide detector is not working properly, or if the lessor is experiencing any other unsafe housing conditions, including but not limited to, animal infestation, lack of heat and water, mold... h- The premises shall be occupied for residential purposes only, and only by the persons disclosed in this lease and on the application for this ease submitted by the lessee in connection with the renting of the premises. i- Lessee shall not install any air conditioning, heating, or cooling equipment or dishwashers or clothes washers or dryers, or other appliances in any portion of the premises occupied by the lessee without first obtaining the lessor's written permission to do so. j- Lessee agrees not to play televisions, radios or musical instruments, or musical playback equipment in a manner that disturbs neighbors. The lessee shall maintain the volume of such equipment at reasonable levels. Also, the lessee agrees to limit playing of such equipment between 10:00 p.m. and 7:00 a.m. to a volume that cannot be heard by persons outside of the premises. k- Lessee shall permit the lessor access to the premises at all reasonable times subject to the reasonable notice requirement as provided by law to make necessary repairs, to conduct maintenance or improvements, to supply necessary or agreed upon services, or to determine the lessee's compliance with the provisions of this lease. In any such event, lessor may interrupt, shut off, or terminate service due to the repair, maintenance, improvement, and service. In the event of an emergency that threatens the safety of the occupants or the lessor's property, lessor may enter the premises within twenty-four (24) hours without the same being considered a forcible entry by lessor. Lessee's failure to provide access to the premises is a breach of this lease, and the lessor shall be entitled to terminate this lease if lessee denies lessor access to the premises. In addition, lessor has the right to access the exterior of the premises for improvements upon giving the lessee 48 hours' notice, the inside of the premises must have the consent of lessee. l- Lessee shall not sublet the premises or any part thereof, nor assign this lease, without obtaining the lessor's written permission before sublet or assign. m- Lessee shall maintain continuous occupancy of the premises, and not allow the same to remain vacant for any period in excess of twenty-one days without notifying the lessor of such vacancy seven days in advance. n- If Lessee defaults in the payment of rent, lessor may terminate the lease with not less than ten (10) days' notice to lessee unless the parties agree otherwise, or lessee pays rent in full before the notice period expires. o- The premises is offered to lessee in compliance with all federal, state, and local fair housing. p- Lessee agrees to test, maintain, and repair any smoke and to replace any batteries, at the lessee's sole expense. q- Upon expiration or termination of this lease, lessee shall immediately vacate and surrender possession of the premises in as good and clean order and condition as the premises were at the beginning of the lease term, reasonable wear and tear excepted. Lessee shall immediately deliver all keys to lessor or lessor's agent. r- If lessee shall violate any covenant or provision of this lease, the lessor shall have the right to terminate this lease or the lessee's right to possession pursuant to the lease upon appropriate legal notice to the lessee. s- Lessor will hand over the water account and utilities account to lessee on the date this lease is signed. t- Cashiers' checks and direct deposit... are methods for sending money such as a security deposit and month's rent . The lessor will provide bank information if the lessee needs it. 6. Rule and Regulation: a- No additional locks or other similar devices shall be attached to any door without lessor's written consent. b- Lessee shall not install a waterbed, pool table, or any other unusually heavy item of furniture without prior written permission from lessor. c- Lessee shall not dispose of rubbish, rags, or other items... which might clog toilets or sink drains into toilets or sink drains. Avoid pouring harsh chemicals down drain and dispose of excess grease in the sink, especially kitchen area. d- Lessee shall dispose of garbage and refuse by securely bagging. Lessee shall not allow garbage containers to overflow and shall see to it that garbage container lids are fully always closed and secure. e- Lessor will repair any appliance malfunction; however, lessor is not responsible for loss resulting from a malfunction of an appliance. Lessee understands that appliances will malfunction occasionally, and lessee must make every effort to report any malfunction. f- Lessee agrees to always clean filters and to keep the laundry area clean. g- Lessee is encouraged not to smoke indoors. Please keep safe and hygienic for yourself, those around you, and premises if any! h- Lessee agrees to maintain the grounds reasonably and prudently. This responsibility includes pruning of all hedges, shrubs, and small trees, weeding of flowerbeds, mowing, and watering grass during periods of drought. i- Lessee shall not park or perform vehicle maintenance on the lawn. The lessee shall not place any indoor furniture on the lawn or porches. j- The wall remote control cover of the parking garage motor must be completely closed after each use. Otherwise, over time, rainwater or cold air will damage it. k- Lessee shall replace the furnace air filter promptly. Delay in doing so may result in damage to compressor of outside unit. l- Lessee is encouraged to use a water softener for whole house. Lessor will install it at their own expense. Lessee shall buy softener salt.
