Lease terms

Renter pays all utilities. Only 2 dogs allowed and must be outdoors. No smoking or tobacco use in or outside the residence. There is no dryer hook up, there is a washer hook up, but no washer. Refrigerator and stove are included in the lease. A. First and last month's rent are due on signing. Inspection of residents every quarter. I. No Ownership or Adverse Possession Claim: Tenant acknowledges that Tenant's occupancy is solely by permission of Landlord under this lease. Tenant has no ownership interest in the property and waives any claim of adverse possession, squatter's rights, prescriptive rights, or any claim inconsistent with Landlord's ownership. Upon expiration or termination of this lease, Tenant must vacate the property as required by law. II. No Unauthorized Occupants: No person may reside at the property unless listed on the lease and approved in writing by Landlord. III. Holdover: If Tenant remains after the lease ends or after lawful termination, Tenant becomes a tenant at sufferance and Landlord may pursue all legal remedies, including eviction, court costs, attorney's fees where allowed, and any lawful damages. IV. No Drugs, Criminal Activity, or Illegal Conduct Tenant, occupants, guests, invitees, and any person present at the property with Tenant's permission shall not engage in, permit, facilitate, or allow any criminal activity, drug-related activity, violent conduct, threats, weapons violations, prostitution, gang activity, theft, vandalism, fraud, nuisance activity, or any other illegal conduct at or near the property. Drug-related activity includes, but is not limited to, the possession, use, manufacture, cultivation, sale, distribution, delivery, storage, or trafficking of any illegal drug, controlled substance, or drug paraphernalia in violation of federal, state, or local law. Tenant is responsible for the conduct of all occupants, guests, invitees, and any person allowed onto the property by Tenant. Any violation of this section shall be considered a material and serious breach of the lease and may result in immediate termination of tenancy, notice to vacate, eviction proceedings, damages, attorney's fees where allowed by law, and any other legal remedy available to Landlord. Tenant further agrees not to use the property in any manner that creates a nuisance, threatens the health, safety, or peaceful enjoyment of others, damages the property, or attracts law enforcement activity due to illegal conduct. Nothing in this section waives Landlord's obligation to follow the legal eviction process required by Texas law. V. Zero Tolerance Notice This property has a zero-tolerance policy for illegal drugs, criminal activity, violence, threats, and unauthorized occupants. Any violation may result in termination of the lease and legal eviction proceedings. VI. Yard Maintenance and Exterior Cleanliness Tenant is responsible for maintaining the front yard, back yard, side yards, driveway, walkways, fence lines, and any exterior areas of the property in a clean, safe, and orderly condition at all times. Tenant shall keep all grass, weeds, shrubs, bushes, and landscaping trimmed, groomed, and maintained. Tenant shall not allow grass or weeds to become overgrown, unsightly, or in violation of any city, county, homeowners association, code enforcement, or municipal requirement. Tenant is responsible for removing trash, debris, junk, discarded furniture, vehicle parts, animal waste, excessive leaves, weeds, and any other items that create an unsightly, unsafe, or unsanitary condition on the property. If Tenant fails to maintain the yard or exterior areas after written notice from Landlord, Landlord may arrange for lawn care, cleanup, weed removal, or other necessary maintenance, and Tenant shall be responsible for reimbursing Landlord for all related costs. Failure to maintain the yard and exterior areas may be considered a lease violation and may result in additional legal remedies available to Landlord under the lease and Texas law.
