RESIDENTIAL LEASE AGREEMENT Property Address: 1422 E Gary Way, Phoenix, AZ 85042 Landlord: Tenant(s): [To be filled upon approval] Lease Date: [Date] 1. Lease Term and Rent Monthly Rent: $2,300.00 per month, due on the 1st of each month. Lease Term: 12 months, beginning on [Move-In Date] and ending on [End Date]. This lease may be renewed only by mutual written agreement. Late Fees: $50 if rent is not received by the 3rd of the month, plus $10 per additional day late. Move-In Costs (due at signing): First Month's Rent: $2,300 Last Month's Rent: $2,300 Security Deposit: $3,000 Total Due at Signing: $7,600 2. Security Deposit Amount: $3,000 (refundable, subject to final inspection and deductions for damages beyond normal wear and tear, unpaid rent, cleaning, key replacement, or other charges allowed by law). The security deposit will be handled in accordance with Arizona law (A.R.S. 33-1321). Landlord will provide an itemized statement of any deductions within 14 business days after tenancy ends and keys are returned. Tenant has the right to request to be present at the move-out inspection. 3. Tenant Responsibilities Tenants are responsible for: Utilities: SRP (electric), City of Phoenix (water, sewer, trash), and internet/cable. HOA Fee: $67 per month. Tenant shall reimburse Landlord for the HOA assessment each month (or pay directly if arranged in writing). Tenant is responsible for any HOA fines or violations caused by their occupancy or guests. Yard Maintenance: Keep the front, back, and side yards clean, free of weeds, and properly maintained. Failure to do so may result in HOA fines, which will be charged to the Tenant. Maintaining the property in a clean and sanitary condition. Reporting any needed repairs to the Landlord promptly in writing. Complying with all HOA rules and CC&Rs. Changing air filters, smoke detector batteries, and light bulbs as needed. 4. Income & Application Requirements Income: Gross monthly household income must be at least 3 times the monthly rent ($6,900 minimum) before taxes. Stable employment history (minimum 6 months preferred with current employer). No prior evictions or rental judgments. Positive rental history and satisfactory references from previous landlords. Clean background check. Application Process: Non-refundable Application Fee: $50 per adult applicant. Each adult applicant must provide: Valid government-issued photo ID. Proof of current car insurance (if applicable). Recent pay stubs (last 30 days) or other income verification. Credit report (Credit Karma copy is acceptable). Approval decision is typically made within 3 business days of receiving all required documents. 5. Pets, Smoking, and Occupancy Pets: Allowed only with prior written approval. Monthly pet rent fee will be charged. Smoking/Vaping: Strictly prohibited inside the home. Outdoor smoking must not create a nuisance for neighbors. Occupancy: Limited to the approved tenants listed above plus any minor children approved in writing. A $300 non-refundable deep cleaning fee will be charged at move-out. 6. Inspections and Landlord Access Landlord (or authorized agent) may enter the property for inspections, repairs, maintenance, or showings with at least 48 hours' notice (1 week preferred when possible) at reasonable times, in accordance with Arizona law (A.R.S. 33-1343). Routine inspections will generally occur every 3 6 months. Emergency access is permitted without notice. 7. Move-In / Move-Out Condition Landlord will provide a Move-In Condition Report at the start of the lease. Tenant must complete and return it within 5 days, noting any pre-existing damage. Tenant agrees to return the property in the same condition as received, except for normal wear and tear. 8. Default, Remedies, and Termination Tenant will be in default under this Agreement if any of the following occur: Failure to pay rent or any other monetary obligation when due. Material damage to the Premises caused by Tenant, authorized occupants, guests, or pets. Repeated violations of any provision of this Lease, HOA rules, or applicable law. Illegal activity or drug-related activity on or near the Premises. False or misleading information provided in the rental application. Abandonment of the Premises. Landlord's Remedies: If Tenant defaults, Landlord may, at Landlord's option and in accordance with Arizona law: Deliver written notice requiring Tenant to cure the breach (typically 5 or 10 days depending on the violation). Terminate the rental agreement and pursue eviction through the courts. Recover possession of the property, unpaid rent, late fees, damages, court costs, and reasonable attorney fees. Pursue any other remedies available under Arizona law. For material and irreparable breaches (e.g., serious property damage, illegal activity, or imminent danger), Landlord may terminate immediately with proper notice and file for eviction. 9. Additional Rules and Provisions No illegal activities on the premises. No alterations, painting, or installation of fixtures/locks without Landlord's prior written consent. Tenant is strongly recommended to maintain renter's insurance. Holdover Tenants: If Tenant remains in possession after expiration or termination of this Lease without Landlord's written consent, Tenant shall pay 200% of the monthly rent (prorated daily) as a holdover tenancy. This does not create a month-to-month tenancy unless agreed in writing. Attorney Fees and Costs: The prevailing party in any legal action arising from this Agreement shall be entitled to recover reasonable attorney fees, court costs, and collection costs. No Waiver: Landlord's failure to enforce any provision on one occasion does not waive the right to enforce it in the future. Indemnification: Tenant agrees to indemnify and hold Landlord harmless from claims, damages, or liability arising from Tenant's negligence or violations of this Lease (except to the extent caused by Landlord's negligence). Trash and recycling pickup is on Friday. Cans must be placed curbside the night before and returned to the side yard the same day. Early termination, assignment, or subletting requires Landlord's written approval and may incur fees. 10. General Provisions This Agreement is governed by the laws of the State of Arizona. Any disputes shall be handled in Maricopa County courts. All non-refundable fees are clearly stated in this document. If any provision is held invalid, the remainder shall remain in full force.
