Lease terms

TENANT AGREES: The following are responsibilities and/or liabilities of the TENANT pursuant to the terms of this lease: A. On time rent payments. Mow the entire 0.25 acres weekly. B. Keep clean and sanitary all parts of the premises, INTERIOR AND EXTERIOR, as well as not to discharge of any fire arms, fireworks or explosive devises. C. Remove and contain all rubbish, garbage and debris according to state, local and municipality laws and to do so, on a regular schedule. Recyclable goods and the sorting there of shall be done into the appropriate containers according to laws. Fees, fines and/or taxes imposed by the regulating agencies to the LANDLORD for failure to comply with the above statements shall be the responsibility of TENANT and this shall indemnify and/or hold harmless said LANDLORD from related taxes, fees or fines and the costs associated with collection of said taxes, fees or fines. D. Provide monthly extermination of pests such as roaches, ants, fleas, spiders and etc. E. Not to destroy, demolish, deface, damage, impair or remove any portion of said premises and must not allow any other person(s) to do so. F. Conduct yourself as must your invitees conduct themselves in a manner which will not hinder or destroy the quiet enjoyment of other TENANTS or neighbors thereof. No music or noise that can be heard beyond 25 feet of the exterior walls of the building. G. Pay all gas, sanitation fee, sewage, cable television and telephone charges incurred during and according to the terms of this lease. . H. TENANT shall not assign, sublet, transfer let, modify, alter, nor make structural or material modifications to the premises or any part thereof according to the terms of this agreement. I. To permit LANDLORD or his representative from time to time to inspect, assess, renovate, decorate, improve or change the dwelling or to show the premises to prospective or real buyers, mortgagers, workers and/or contractors. J. At the termination of said agreement TENANT shall quietly yield up premises in a rentable, clean and empty manner (excluding normal wear and tear outside of fire damage at TENANT'S fault and cost) as it was rented to TENANT at the inception of this agreement. K. Provide special insurance covering flood damage which may be caused by TENANT'S possible waterbed or aquarium. A proof of insurance record must be furnished and made payable to the LANDLORD. L. TENANT agrees that LANDLORD shall not be responsible for injury or damage on or about the premises except where such is due to LANDLORD'S negligence. TENANT is responsible for obtaining fire, extended coverage and liability insurance with respect to the personal contents of TENANT on the premises as well as protect the LANDLORD from liability as a result of actions on the part of the TENANT and/or their invitees, guest, family or licensees. M. Release and indemnify LANDLORD against all losses incurred when (1) conditions of this agreement are not met, (2) damage or injury not caused by LANDLORD, (3) damage or loss caused by TENANT'S guests, invitees or family of or to their own property, (4) TENANT'S failure to comply with any government agency. N. TENANT wholly responsible for any fees, cost, litigation expenses, before, during and after any such case may be brought against TENANT while under this agreement for any associated loss and hold LANDLORD harmless for any such case related to said losses as agreed to herein. O. TENANT will voluntarily terminate this agreement and quietly yield up premises if any and all of these conditions are not met. P. TENANT will accept responsibility of testing monthly the smoke detector(s) provided by the LANDLORD and keep operational at all times, notifying LANDLORD immediately if any problems arise concerning said smoke detector(s). Q. TENANT will accept responsibility of monthly cleaning and/or replacing dirty or damaged air condition filter(s). Damage caused by neglect of TENANT to do so will be the financial burden of said TENANT and must be reported to LANDLORD immediately. R. TENANT agrees not to commit or permit any illegal acts upon the premises, by anyone and if such occurs, agrees to vacate peacefully said premises within three (3) calendar days after notice by LANDLORD. S. TENANT agrees that no modification, release, discharge or waiver of any provisions hereof shall be of any force, effect or value unless by writing authorization of LANDLORD or his representative. T. TENANT shall return possession of the leased premises in its present condition, reasonable wear and tear, and fire casualty excepted and shall commit no waste to the premises at the expiration of said lease. U. TENANT shall comply with all building, zoning, health and all other applicable codes and laws for the leased premises. LANDLORD AGREES: A. LANDLORD shall maintain the exterior of the premises in good repair. TENANT shall report any problems to the LANDLORD in writing. All repairs shall be made in a timely manner as deemed necessary by the LANDLORD at no cost to the TENANT, providing that the TENANT or TENANT'S invitees, family or guests are not responsible for the said problem. B. Landlord shall not abuse the right of access nor use it to harass the TENANT. C. If premises or any part thereof should be destroyed by fire, storm or other casualty, payment of rent shall be suspended or pro rata commensurate to damage until LANDLORD has reinstated said premises as fit for habitation by TENANT unless destruction is otherwise such that LANDLORD does not desire to renovate or reconstruct said premises. LANDLORD reserves the right to terminate this agreement at its sole discretion following said casualty as afore mentioned. D. In accordance with the Florida Residential Landlord and Tenant Act, LANDLORD neither makes nor implies any warranties, except as outlined by this agreement, of any kind, nature or description of or concerning premises. TENANT has inspected the premises and accepts same "as is", where is, and with all faults". E. In the event of any breach of the payment of rent or any other allowed charge, or other breach of this lease, LANDLORD shall have full rights to terminate this lease in accordance with state law and re-enter and claim possession of the leased premises, in addition to such other remedies available to LANDLORD arising from said breach.
