Utilities & Services: Tenant shall be solely responsible for establishing, maintaining, and paying for all utilities and services serving the residence, including but not limited to water, sewer, electricity, trash, recycling, internet, cable, and any other services used at the Property. Utilities shall remain active at all times during the Lease Term. Any interruption or disconnection of utilities due to nonpayment shall constitute a material breach of this Lease. Maintenance, Yard Care & Upkeep: Tenant accepts responsibility for the routine care, upkeep, and maintenance of the entire Property, including the home, yard, driveway, sidewalks, fencing, and any appurtenant structures. Tenant's responsibilities include, but are not limited to: Regular lawn mowing, edging, watering, and weed control Maintenance of shrubs, trees, flower beds, and landscaping Removal of trash and debris from yard and exterior areas Replacement of HVAC air filters, light bulbs, and batteries Maintaining proper heating and air conditioning use to prevent damage Preventing mold and mildew through proper ventilation and cleanliness. Tenant shall promptly notify Landlord in writing of any condition requiring repair beyond routine maintenance. Damage resulting from Tenant's failure to maintain the Property, including damage to landscaping, plumbing, HVAC systems, or structural components, shall be considered Tenant-caused damage and shall be Tenant's financial responsibility. HOA Compliance: Tenant agrees to comply with all HOA rules, regulations, covenants, conditions, and restrictions applicable to the residence, including but not limited to parking, landscaping, noise, trash placement, and exterior appearance. Any HOA fines, penalties, assessments, or enforcement costs arising from Tenant's actions or omissions shall be paid by Tenant and shall be deemed additional rent, immediately due upon notice. Pets & Animals: No pets or animals of any kind are permitted on the Property without prior written approval from Landlord. This includes visiting, temporary, or overnight animals. If any unauthorized pet or animal is found on the Property, Tenant agrees to pay a one-time, non-refundable pet fee of $200 per animal, due immediately. The presence of an unauthorized pet constitutes a material breach of this Lease and may result in lease termination, notice to vacate, and eviction under Texas Property Code Chapter 24. This fee does not limit Tenant's responsibility for additional cleaning, pest treatment, odor remediation, yard damage, or property damage caused by any animal. Rent, Late Fees & Default: Monthly rent is due on the 1st day of each month, without demand. Rent not received within the first five (5) business days shall incur a late fee of $50. If rent remains unpaid after ten (10) days, an additional late fee of $100 shall be assessed. Late fees are agreed to be reasonable liquidated damages under Texas Property Code 92.019 and shall be considered additional rent. Default, Notice & Remedies: Any failure to pay rent, late fees, utilities, HOA charges, pet fees, or other amounts due, or violation of any Lease term, shall constitute a default. Upon default, Landlord may exercise all remedies allowed under Texas law, including but not limited to: Issuing a Notice to Vacate pursuant to Texas Property Code 24.005 Terminating the Lease Filing a forcible detainer (eviction) action Recovering unpaid rent, fees, damages, attorney's fees, court costs, and possession of the Property Acceptance of late or partial payment does not waive Landlord's rights or remedies. Security Deposit & Possession: Tenant remains responsible for all Lease obligations until the Property is fully surrendered, all keys and access devices are returned, and possession is restored to Landlord. Landlord may deduct unpaid rent, fees, damages, and authorized charges from the security deposit in accordance with Texas Property Code Chapter 92.
