Terms at 1270 Whispering Ln

1. Lease Term This Lease Agreement is for a fixed term of twelve (12) months, commencing on [Start Date] and terminating at 11:59 PM on [End Date], unless terminated earlier in accordance with this Lease or extended by written agreement signed by both Landlord and Tenant. If Tenant remains in possession after expiration of the Lease without a written renewal agreement, tenancy shall convert to a month-to-month tenancy at a rental rate of $2,850 per month (or another specified rate), subject to 30 days' written notice by either party pursuant to Florida law. Time is of the essence with respect to all payment and performance obligations. 2. Rent Monthly rent is $2,700, payable in advance on or before the first (1st) day of each month. Payment shall be made via electronic transfer to: [Landlord Name / Account Details] Rent is considered received only when funds have cleared. Late Fee If rent is not received by 11:59 PM on the fifth (5th) calendar day of the month, Tenant shall pay a one-time late fee equal to 5% of the monthly rent ($135). Late fees are additional rent. Returned Payments Any returned or rejected payment shall incur a returned payment fee in accordance with Florida Statute 68.065. After a returned payment, Landlord may require future payments in certified funds or other guaranteed form. 3. Security Deposit Tenant shall pay a security deposit of $2,700 prior to occupancy. The security deposit shall be held and administered in accordance with Florida Statute 83.49. The security deposit shall not be applied toward rent unless agreed to in writing by Landlord. Upon termination of tenancy, deposit handling (return or notice of claim) shall comply strictly with Florida statutory timelines. 4. Utilities and Services Tenant shall be solely responsible for establishing and maintaining active utility accounts in Tenant's name prior to occupancy and throughout the Lease Term, including but not limited to: Water Electricity Internet/Cable/Telephone Trash service (if applicable) Proof of active accounts must be provided prior to move-in. Utilities must remain active through the date of final inspection. Landlord shall be responsible for HOA dues; however, Tenant is responsible for any fines, violations, or penalties resulting from Tenant's conduct. 5. Use and Occupancy The Premises shall be used exclusively as a private residential dwelling by the Tenant(s) listed in this Lease. No business activity, short-term rentals (including Airbnb or similar platforms), or commercial use is permitted. No subleasing or assignment is permitted without prior written consent of Landlord. Tenant shall comply with all applicable federal, state, and local laws, as well as all HOA rules and regulations. 6. Maintenance and Repairs Tenant agrees to maintain the property in clean, safe, and sanitary condition. Tenant responsibilities include, but are not limited to: Replacing HVAC filters monthly Replacing light bulbs Lawn and landscaping maintenance (if applicable) Pest control due to infestation caused by Tenant Clogged drains due to misuse Damage beyond normal wear and tear Landlord shall be responsible for structural components and systems, including roof, plumbing, electrical, and major appliance failures not caused by Tenant negligence. Tenant shall promptly notify Landlord in writing of any needed repairs. Failure to report damage may result in Tenant liability for resulting damage. 7. Early Termination In accordance with Florida Statute 83.595, Tenant agrees that if Tenant elects to terminate the Lease prior to expiration of the Lease Term, Tenant shall pay an early termination fee equal to two (2) months' rent ($5,400). Upon payment of such early termination fee and surrender of possession, Landlord waives the right to seek additional rent beyond the month in which Landlord retakes possession. Security deposit shall not automatically apply to the early termination fee unless agreed in writing. 8. Default Failure to pay rent or comply with material provisions of this Lease shall constitute default under Florida law and may result in statutory notice, eviction proceedings, damages, and recovery of attorney's fees and court costs. 9. Governing Law and Venue This Lease shall be governed by the laws of the State of Florida. Venue for any legal action shall be in the county where the property is located. The prevailing party in any action to enforce this Lease shall be entitled to recover reasonable attorney's fees and court costs.
