This Room Rental Lease Agreement ("Agreement") is made and entered into this _____ day of __________________, 2026, by and between: Landlord / Primary Tenant: Antonio Caniglia AFC ("Landlord") Tenant / Roommate: _______________________________________ ("Tenant") The parties agree to the following terms and conditions regarding the rental of the Premises specified below. 1. PREMISES Property Address: 125 Calais Pl, Cherry Run, WV 25427 Room Description: Private bedroom located on the second floor (front left room) with access to a private upstairs bathroom ("Room"). Shared Spaces: The Tenant shall have shared access to common areas, including the kitchen, living room, downstairs shared bathroom, dining area, and laundry facilities. 2. LEASE TERM Select one option below by checking the appropriate box: [ ] 3-Month Term: Begins on __________________, 2026, and ends on __________________, 2026. [ ] 6-Month Term: Begins on __________________, 2026, and ends on __________________, 2026. Upon expiration of the term, this Agreement will automatically convert to a month-to-month tenancy unless either party provides written notice of non-renewal at least 30 days prior to the end date. 3. RENT & PAYMENTS Monthly Rent Amount: $1,000.00 USD per month. Due Date: Rent is due on or before the 1st day of each calendar month. Payment Method: Payments shall be made via Bank Transfer, Zelle, or Cash App to: Antonio Caniglia Late Fee: Rent paid after the 1st day of the month will incur a late fee of $100.00. 4. SECURITY DEPOSIT Deposit Amount: $750.00 USD due upon signing this Agreement. Return of Deposit: In accordance with W. Va. Code 37-6A-1, the Security Deposit will be returned within 60 days after the Tenant vacates the Premises (or within 45 days if a new tenant occupies the room immediately), along with an itemized accounting of any lawful deductions for unpaid rent or damages beyond standard wear and tear. 5. UTILITIES & SERVICES [x] Included: All utilities (Water, Gas, Electricity, Trash Service, and Internet) are included in the Monthly Rent. 6. HOUSE RULES & POLICIES 1. Quiet Hours: Observed from 10:00Pdaily. 2. Smoking & Vaping: [x] Strictly prohibited inside the Premises. 3. Overnight Guests: Guests may not stay for more than 2 consecutive nights or 4 total nights per month without prior written consent from the Landlord. 4. Pets: Pets are not permitted on the Premises. 5. Cleanliness: The Tenant agrees to maintain the Room in a clean, sanitary condition and to clean up after themselves in all shared areas immediately after use. 7. LANDLORD ACCESS & MAINTENANCE Notice of Entry: The Landlord shall provide at least 24 hours' written notice before entering the Room for non-emergency repairs, inspections, or showings. Immediate entry is permitted only in emergencies (e.g., pipe bursts, fire). Landlord Responsibilities: Maintain structural integrity, plumbing, electrical systems, heating, and major appliances provided with the property in compliance with local health and safety codes. Tenant Responsibilities: Keep the Room clean, report maintenance issues promptly, and reimburse the Landlord for damage caused by negligence or misuse. Habitability & Repairs: If a health or safety defect arises and the Landlord fails to make repairs within 14 days of written notification, the Tenant retains rights under West Virginia law (Teller v. McCoy) to arrange repairs and deduct costs from rent. 8. GOVERNING LAW This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of West Virginia, Berkeley County. 9.
