1. USE Only the individuals listed as Tenant(s) and the occupants identified below are permitted to use the premises as a permanent residence: Chatara Antoinette Jenkins Atara Payne (Child of Chatara Jenkins) Tenant and Co-signer agree to assume full responsibility for the actions of any person entering the property. Landlord will hold Tenant and Co-signer responsible for all damages resulting from violations of this agreement. Tenant agrees not to assign this agreement, sublet any part of the property, or allow any other person to reside therein without the Landlord's prior written permission. Any attempt to do so without permission will result in immediate termination of this lease. TENANT UNDERSTANDS AND AGREES THAT ANY USE OR POSSESSION OF ILLEGAL DRUGS UPON THE PREMISES SHALL CONSTITUTE A SERIOUS BREACH OF THIS LEASE AGREEMENT AND WILL RESULT IN IMMEDIATE TERMINATION. 2. RENT Rent shall be paid in cash, money order, or certified check payable to Syracuse Rentals LLC and delivered to the Landlord, Joshua Oddo. Rent is collected monthly by the Landlord. Tenant agrees to pay the Landlord base rent in the amount of $1,500.00 per month, due and payable in advance on the first day of each month. If rent is not received by the 5th of the month: A $50.00 late fee will be charged on the 6th. An additional $5.00 per day will be charged from the 7th through the 14th. Eviction proceedings may be initiated on the 15th. Late fees, returned check fees, and attorney fees will be treated as additional rent. No excuses (including illness, job loss, or financial hardship) will be accepted for late payment. If any tenant withdraws from the lease, the remaining tenant(s) remain responsible for the full rent amount. 3. SECURITY DEPOSIT The Tenant has provided, and the Landlord acknowledges receipt of, $1,500.00 as a security deposit. The security deposit will be returned to the Tenant, along with any required itemized statement of deductions, within fourteen (14) days after the Tenant vacates the premises and returns all keys, less any reasonable charges for damages beyond normal wear, unpaid rent, late fees, cleaning, utilities, or other permitted deductions. The full security deposit will be forfeited if the Tenant does not complete the full term of the lease for any reason. The security deposit may not be used by the Tenant as payment for the last month's rent. Any remaining balance will be returned to the Tenant at the forwarding address provided. 4. ABANDONMENT & DEFAULT Abandonment: If the premises are left unoccupied for 15 days without payment of rent in advance, or while owing back rent, the Landlord may take immediate possession and bar the Tenant from returning. The Landlord may remove and store any property left behind at the Tenant's expense. Default: If Tenant fails to pay rent or breaches any other term of this lease, Landlord may pursue all legal remedies, including eviction, damages, costs of re-renting, attorney fees, advertising fees, and any loss of rent. Tenant and Co-signer are jointly and severally liable for all such costs. 5. OCCUPANCY AND TENANT RESPONSIBILITY Tenant agrees to maintain the premises in a clean, sanitary condition and to preserve the general structure and appearance of the property. Tenant is responsible for any damage caused by negligence (e.g., leaving windows open during storms, allowing pipes to freeze or overflow, broken windows/doors/locks, etc.). Tenant agrees to: 1. Comply with all obligations imposed by applicable building codes affecting health and safety. 2. Dispose of all rubbish, garbage, and waste in a clean and safe manner. 3. Use all electrical, plumbing, heating, ventilating, air-conditioning, and other facilities and appliances reasonably. 4. Not deliberately or negligently destroy, damage, impair, or remove any part of the premises or permit others to do so. 5. Keep televisions, stereos, and other devices at a volume that does not disturb other residents. 6. Never leave open or smoldering flames unattended; extinguish all flames before leaving the property. 7. Maintain stairs in a safe condition to prevent slipping. 8. Not store, place, or leave any personal property (including furniture, bicycles, trash, or other items) in common areas such as hallways, stairways, entryways, porches, landings, or sidewalks. Common areas must remain clear and unobstructed for safety, fire code compliance, and property appearance. Landlord may remove items left in common areas without notice, at Tenant's expense, and Tenant is responsible for any related costs or fines. Failure to perform these obligations may result in termination of the lease and forfeiture of all or part of the security deposit. 6. UTILITIES Tenant is responsible for all utilities (electric, gas, internet, etc.) and must have them transferred into their name upon move-in. Landlord will cover water charges. Unpaid utility bills at termination may be deducted from the security deposit. 7. APPLIANCES The premises are provided with the following appliances in good working condition: refrigerator, stove, microwave. Tenant agrees to return them in the same condition, reasonable wear excepted. Landlord-owned washer and dryer (if present) are provided as a courtesy; Landlord is not responsible for replacement if they fail and will repair at his discretion when possible. Any appliances owned by Tenant are the Tenant's responsibility. 8. PETS & SMOKING POLICY Violation of this policy will result in immediate termination of the lease. No pets are allowed without Landlord's prior written permission and an additional monthly fee. No smoking of any kind is permitted inside the building at any time. 9. PROPERTY CONDITION & CLEANING FEE Tenant accepts the property in its current condition. Tenant agrees to return the premises in the same condition, reasonable wear excepted, or pay a minimum $400.00 cleaning fee for professional cleaning. 9-b. LOCKOUT FEES First occurrence: No fee Second occurrence: $25.00 Third and subsequent occurrences: $50.00 minimum Fees are due at the time of re-entry. 10. BEDBUGS Pursuant to NYS Property Maintenance Code 308.4, Landlord is responsible for extermination in public/shared areas. Tenant is responsible for extermination within the occupied unit. Tenant is advised to inspect used furniture and clothing to avoid introducing bedbugs. 11. PROPERTY MAINTENANCE Tenant must keep the premises clean and in good order, notify Landlord promptly of needed repairs, and report safety/security concerns immediately. Landlord will handle repairs. Landlord is responsible for lawn/landscaping maintenance. Tenant is responsible for snow and ice removal from sidewalks, stairs, entryways, common areas, and pathways adjacent to the unit to prevent hazards and comply with City of Syracuse requirements. Landlord is not liable for damages or injuries resulting from Tenant's failure to remove snow/ice. Tenant may not paint, wallpaper, alter, or make improvements without Landlord's prior written consent. Any such alterations become Landlord's property. 12. TELECOMMUNICATIONS Landlord will authorize installation of cable/internet services (e.g., Spectrum, Fios). No modifications to the structure (e.g., satellite dishes) are permitted. 13. PLUMBING AND ELECTRICITY Tenant agrees not to put or pour any debris, grease, paper towels, Q-tips, tampons, newspaper, food, or any other matter in the sink drain or toilets. Tenant specifically agrees not to flush "flushable" wipes, wet wipes, baby wipes, disinfectant wipes, personal hygiene wipes, or any similar non-toilet-paper products down the toilet or drains. These items do not disintegrate properly (even if labeled "flushable") and can cause severe blockages in plumbing, sewer lines, or the municipal system. Tenant is fully responsible for the entire cost of any clogs, backups, overflows, repairs, cleaning services, or related damages resulting from flushing or disposing of prohibited items (minimum charge of $150.00 or the actual amount incurred, whichever is greater; cost shared between units in a multi-unit building if applicable). Tenant must not overload electrical circuits. Only two electrical devices may be plugged into any single receptacle. 14. VEHICLE POLICY No off-street parking is provided. Non-functional or unlicensed vehicles are not permitted on the property. Removal will be at Tenant's expense. 15. ACCESS TO PREMISES Landlord may enter the premises at reasonable times with 24 hours' notice (when possible) to inspect, make repairs, provide services, or show the property to prospective tenants/buyers. "For Rent" or "For Sale" signs may be displayed. 16. INDEMNIFICATION Landlord is not liable for damage or injury to Tenant, occupants, guests, or property. Tenant agrees to indemnify and hold Landlord harmless from all claims arising from Tenant's use of the premises. 17. CITY, COUNTY, OR STATE VIOLATIONS Tenant is responsible for all violation fees issued due to Tenant's non-compliance. If Landlord must appear in court, Tenant will pay an additional $350.00 fee. Tenant must promptly notify Landlord of any citations received. 18. LEAD PAINT DISCLOSURE The property was built before 1978 and may contain lead-based paint. Landlord has provided Tenant with EPA pamphlet #747-K-99-001. Contact Landlord if a replacement is needed. 19. SEMI-ANNUAL INSPECTIONS Landlord will conduct semi-annual inspections of the interior and exterior with at least 48 hours' notice. If the property is not maintained in the condition provided, Landlord may take corrective action, including possible eviction for non-compliance. 20. GARBAGE AND TRASH REMOVAL 1. Tenant is responsible for proper handling, storage, placement, and retrieval of garbage, trash, and recycling in full compliance with City of Syracuse Department of Public Works rules and ordinances. 2. Landlord provides assigned city-issued carts (black for trash, blue for recycling) for the exclusive use of this unit (Apartment 2). 3. Tenant must place carts at the curbside no earlier than 6:00 p.m. the evening before the scheduled collection day (per current City schedule). 4. Tenant must retrieve and return carts to their proper location by 7:00 p.m. on the scheduled collection day. 5. Trash must be bagged and fully contained within the cart; lids must close completely; no overflowing or loose items. Recycling must follow City/OCRRA sorting guidelines. 6. Tenant is fully responsible for any fees, fines, tickets, or charges resulting from improper set-out, overflowing carts, damage due to misuse, late retrieval, or other non-compliance.
