Residential Lease Terms Property: 1213 Park Ave., Alameda, CA Property Type: Apartment Unit in a Four-Plex Lease Term: One (1) Year Fixed Term with Option for Renewal 1. Lease Term The lease shall commence on the agreed start date and continue for a fixed term of one (1) year. Any renewal shall be subject to mutual written agreement between Landlord and Tenant and may include revised rental terms as permitted by applicable law. 2. Rent Tenant shall pay monthly rent in the amount of $2,580.00, due on or before the first (1st) day of each month. Rent shall be paid in the manner designated by Landlord. 3. Late Fees If rent is not received within three (3) calendar days after its due date, Tenant shall pay a late fee of $50.00. The assessment of a late fee does not waive Landlord's right to pursue any other remedies available under the lease or applicable law. 4. Security Deposit Tenant shall deposit $2,580.00 as a security deposit before occupancy. The security deposit may be used as permitted by California law, including but not limited to: Unpaid rent; Repair of damages beyond ordinary wear and tear; Cleaning necessary to return the premises to the same level of cleanliness as at move-in, subject to applicable law; and Other lawful deductions. Any remaining balance shall be returned within the timeframe required by California law. 5. Utilities Landlord shall pay: Gas Water Electricity Garbage collection Tenant shall be solely responsible for: Internet service Cable television Telephone service Any other optional communication or entertainment services 6. Occupancy Only individuals listed on the lease agreement may occupy the premises as their primary residence. Tenant shall not permit additional occupants to establish residency without prior written approval from Landlord. 7. Guest Policy Guests may stay at the premises for: No more than seven (7) consecutive nights; and No more than fourteen (14) total days during any six-month period unless prior written permission is obtained from Landlord. Guests who exceed these limits without approval may be considered unauthorized occupants and constitute a lease violation. 8. No Pets Pets of any kind are prohibited on the premises without prior written authorization from Landlord. This provision does not apply to service animals or other accommodations required by law. 9. No Smoking Smoking is prohibited within: The apartment unit; Common areas of the property; and Any area where smoking is prohibited by law or property rules. This prohibition includes cigarettes, cigars, pipes, vaping devices, electronic cigarettes, marijuana, and similar smoking products. Tenant shall be responsible for any cleaning, deodorization, or repair costs resulting from violations of this provision. 10. Parking The property does not include assigned parking spaces. Tenant and guests may utilize available street parking in accordance with all local parking regulations and restrictions. Landlord does not guarantee the availability of street parking. 11. Maintenance and Care of Premises Tenant shall: Maintain the premises in a clean and sanitary condition; Promptly notify Landlord of maintenance issues; Properly dispose of trash and recycling; Use all fixtures, appliances, and systems in a reasonable manner. Tenant shall be responsible for damage caused by Tenant, household members, guests, or invitees. 12. Alterations Tenant shall not paint, remodel, install fixtures, replace locks, mount satellite dishes, or make structural changes without Landlord's prior written consent. 13. Subletting and Assignment Subletting, short-term rentals, assignments, or any transfer of occupancy rights are strictly prohibited without Landlord's prior written consent. Listings on platforms such as Airbnb, Vrbo, or similar services are prohibited unless expressly authorized in writing by Landlord. 14. Compliance With Laws Tenant shall comply with all federal, state, county, and local laws, ordinances, and regulations affecting the use and occupancy of the premises. 15. Renewal Option Approximately sixty (60) days before lease expiration, Landlord may offer a renewal lease. Any renewal shall be subject to: Tenant remaining in good standing; Compliance with all lease terms; and Any lawful rent adjustments or revised lease provisions.
