Lease Terms 1. Rent & Move-In * Tenant shall pay the first month's rent and the security deposit before taking possession of the property. * Rent is due on the date specified in the lease. Must inform 1 month before move out or potentially loss of deposit, can communicate with landlord. 2. Utilities * Landlord will contribute $120 per month toward the property's solar/electric costs. * Tenant is responsible for paying the remaining balance of the PG&E bill after the landlord's $120 contribution. * Tenant is responsible for all water and trash service charges. The water bill includes service for both units. 3. Lawn Maintenance * Landlord will arrange and pay for professional lawn maintenance once each month. * Tenant shall keep their outdoor area reasonably clean between scheduled services, including removing pet waste, litter, and debris. 4. Pets * A maximum of two (2) pets is permitted, subject to the landlord's written approval. * Tenant is responsible for any damage or excessive cleaning resulting from pets. 5. Landlord Responsibilities The landlord is responsible for: * Structural repairs to the home. * Roof, foundation, exterior walls, and major building components. * Plumbing, electrical, gas, heating, and other major systems, except when damage is caused by the tenant or tenant's guests. * Repairs resulting from normal wear and tear. * Maintaining the property in a habitable condition as required by California law. * Providing annual lawn maintenance. * Providing proper notice before entering the property, except in emergencies. 6. Tenant Responsibilities The tenant agrees to: * Keep the home clean, sanitary, and in good condition. * Promptly report maintenance issues, leaks, plumbing problems, electrical concerns, pest activity, or any condition that could cause additional damage. * Replace standard light bulbs as needed. * Replace HVAC air filters, if applicable. * Properly dispose of all household trash and recycling. * Use only the trash, recycling, and green waste containers assigned to this rental unit. The two rental units shall not use each other's assigned bins without mutual permission. * Place trash and recycling containers out for collection on the appropriate day and return them after pickup. * Clean up all pet waste and maintain pet areas. * Avoid pouring grease, oils, coffee grounds, or other materials down drains. * Avoid flushing wipes, paper towels, feminine hygiene products, diapers, or any item other than toilet paper. * Be responsible for repairing holes in walls that are larger than the size of a U.S. quarter, unless caused by normal settling or repairs performed by the landlord. * Pay for repairs resulting from damage caused by the tenant, occupants, pets, or guests. * Obtain written approval before making alterations, painting, installing fixtures, or modifying the property. 7. Plumbing * If a toilet, shower, sink, or drain becomes clogged due to misuse by the tenant, the tenant shall be responsible for the cost of clearing the blockage. * The plumber's written findings will determine the location and likely cause of the blockage. * If the plumber cannot reasonably determine which unit caused the blockage, the plumbing service charge shall be divided equally (50/50) between the occupants of 1212 Saint Frances and 1214 Saint Frances, unless otherwise agreed in writing. 8. Property Inspections * Landlord may conduct one routine annual inspection of the property. * Except in emergencies, entry will be made only after providing notice as required under California law. 9. Occupancy * Only individuals listed on the lease may occupy the property unless written approval is obtained from the landlord. 10. Illegal Activity * Illegal activity on the property is prohibited and constitutes a violation of this lease. 11. Renter's Insurance * Tenant is required to maintain renter's insurance throughout the lease term and provide proof of coverage before move-in and upon request. 12. Parking * The driveway is reserved exclusively for the occupants of 1212 Saint Frances. * Tenant shall park only in areas designated by the landlord. 13. Backyard Use * The backyard immediately outside the sliding glass door is a shared outdoor space for the occupants of both units. * The backyard area located on the right side of the property when facing the home is reserved for the exclusive use of the tenant of this unit. * Landlord may access the private yard only when reasonably necessary for maintenance, repairs, inspections with proper notice, or emergencies. 14. Quiet Hours * Quiet hours are from 10:00 p.m. to 7:00 a.m. * Tenant is granted five (5) quiet-hour exceptions per calendar year, during which gatherings may continue until 1:00 a.m. * Additional exceptions may be made only if the occupants of 1212 Saint Frances and 1214 Saint Frances mutually agree in advance. 15. Lease Violations * Failure to comply with the terms of this lease may result in notices and other remedies permitted under California law.
