RESIDENTIAL LEASE AGREEMENT 1. PROPERTY AND TERM The Owner agrees to lease the dwelling located at ____________________ to the Tenant for a term of 12 months, beginning on ____________________ and ending on ____________________. 2. RENT AND FEES Monthly Rent: $__________ payable in advance on the 1st day of every calendar month. Late Fees: A 20% late fee will be charged on all lease payments not received by the 3rd of the month. Collection: Rent is to be picked up from the locked entryway of the property by 9:30 a.m. on the 1st of the month. 3. DEPOSITS Security Deposit: $__________ Pet Deposit (if applicable): $__________ Refund Policy: Deposits will be refunded within 30 days after the Tenant has moved out completely and returned all keys, provided the property is clean and undamaged. The security and pet deposits cannot be used toward the last month's rent. 4. INCLUDED PROPERTY & APPLIANCES All appliances and equipment provided with the home are the sole property of the Owner and MUST remain on the premises upon move-out or eviction. This includes, but is not limited to: Interior Appliances: Refrigerator, stove/oven, washer, and dryer. Maintenance Equipment: Lawn mower, weed eater, and any tools provided for property upkeep. Removal: Any unauthorized removal of these items will be considered theft and will be prosecuted to the full extent of the law. 5. UTILITIES AND LIABILITY Tenant Responsibility: Tenant agrees to pay all actual costs of UTILITIES used while residing at this address, including all security deposits owed to utility companies. Termination for Non-Payment: Tenant agrees to VACATE the premises within 2 days after being notified in writing of a breach due to non-payment of utilities. 6. NOTICE TO VACATE AND HOLDOVER Notice: Tenant must give 30 days' written notice of their intention to vacate. Holdover: If the Tenant remains after the lease is terminated, rent shall accrue at a rate of 2.5 times the normal daily rental rate. 7. TENANT OBLIGATIONS & MAINTENANCE 1. Pet Policy: Pets are STRICTLY PROHIBITED. However, an exception may be made for one (1) approved pet, requiring an additional pet deposit and separate agreement. 2. Maintenance Reporting: Tenant must notify the Owner immediately of any maintenance issues. Failure to communicate issues in a timely manner may result in the forfeiture of the security deposit. 3. Renter's Insurance: Tenant must maintain insurance covering personal property loss and water-related damages. 4. Drug-Free Policy: There shall be NO ILLEGAL DRUG USE on the property, including the interior and exterior. 5. Smoking Prohibited: Smoking inside the residence is STRICTLY PROHIBITED and results in automatic loss of the security deposit. 6. Exterior Maintenance: Exterior must be well maintained, including the yard, patio/porch, garbage area, sidewalk, and parking area. 7. Seasonal Care: Tenant is responsible for all grass cutting and seasonal snow/ice removal. 8. Condition of Property: Dwelling must be left CLEAN and UNDAMAGED. If a dumpster or professional cleaning crew is required, the cost will be charged to the Tenant. 9. Conduct: No loud or alcoholic parties. Violation results in a 3-day notice to vacate. 8. ACCESS AND EVICTION Access: Owner may inspect or show the property at all reasonable times. During the notice period, access is permitted daily from 10:00 a.m. to 7:00 p.m. Police/Illegal Activity: If police are called to the property for any reason, Tenants are automatically evicted and all deposits are forfeited. Legal Costs: The prevailing party in any legal action shall recover all court costs and reasonable attorney's fees.
