Lease terms

1. Security Deposit Tenant agrees to pay a security deposit of $4,300.00 USD prior to moving in. This deposit is held to cover damages, unpaid rent, and or cleaning fees. The security deposit will be returned within 21 days after the tenant vacates the premises, minus any necessary deductions, which will be itemized in writing. 2. Rent Payment and Late Fees The monthly rent is $4,300.00 USD and is due on the first day of each month. Rent may be paid via cash, Zelle, wire transfer, or money order. If rent is not received by five (5) days after the due date, a late fee of 5% of total monthly rent payment will be charged. If rent remains unpaid for three (3) days after the five (5), the landlord reserves the right to issue a 3-day notice to pay rent or quit and begin the eviction process. 3. Lease Term and Renewal The lease term begins on move-in date agreed by future tenant and landlord and ends on date agreed by tenant and landlord at the time of lease signing. This is a fixed-term lease. If either party wishes to terminate the lease at the end of the term, 30 days written notice must be provided. If no notice is given, the lease will continue under the same terms. 4. Occupancy Limits Only the individuals listed in the lease agreement are authorized to live in the rental unit. Additional occupants are not allowed without prior written consent from the landlord. Unauthorized occupants are grounds for termination of the lease. 5. Maintenance and Repairs Tenants are responsible for routine maintenance tasks such as changing light bulbs and keeping the property clean and sanitary. The landlord is responsible for repairs to ensure the habitability of the unit, including plumbing, electrical, and heating systems. Tenants must report any damage or necessary repairs to the landlord immediately. 6. Property Condition and Inspections A move-in checklist will be completed and signed by both parties upon move-in. Tenants agree to maintain the property in the same condition. The landlord may conduct periodic inspections with at least 24 hours' written notice to ensure the property is being properly maintained. 7. Alterations and Modifications Tenants may not make alterations or improvements to the rental unit, including painting, installing fixtures, or making structural changes, without prior written permission from the landlord. Unauthorized modifications must be restored to their original condition at the tenant's expense. 8. Subletting and Assignment Subletting or assigning this lease is prohibited without prior written consent from the landlord. Violation of this provision is grounds for termination of the lease. 9. Utilities Tenants are responsible for paying the following utilities including gardener ($80.000 USD/mo to be paid directly to gardener on or around the 1st of every month. Landlord will pay trash. 10. Pets Pets (dog/cat) are not allowed in the rental unit unless previously discussed and agreed upon between tenant and landlord. 11. Insurance Requirements Tenants are required to obtain renter's insurance and provide proof of coverage prior to move-in. The landlord is not responsible for the loss or damage of tenant's personal property. 12. Smoking and Illegal Activities Smoking/vaping is not permitted inside the rental unit. Tenants agree not to engage in illegal activities on the premises. Violations of this clause are grounds for immediate termination of the lease. 13. Right of Entry The landlord reserves the right to enter the rental unit for repairs, inspections, or showings with at least 48 hours written notice, except in emergencies, where no notice is required. 14. Lease Violations and Remedies Any violation of the lease terms, including non-payment of rent, unauthorized occupants, property damage, or illegal activities, may result in the termination of the lease. The landlord reserves the right to begin eviction proceedings if lease violations are not corrected within five (5) days after notice is provided. 15. Property Showings In the event the landlord seeks to sell or re-rent the property, the tenant agrees to allow reasonable access for showings with at least 48 hours' written notice. 16. Abandonment of Property If the tenant abandons the rental unit or fails to remove personal belongings after vacating, the landlord may dispose of these items in accordance with California law.
