Lease terms

Lease Duration 12-month fixed-term lease commencing on the date of occupancy as agreed upon by both parties at signing. Tenant must provide 60 days written notice of intent to vacate prior to lease end. Failure to provide timely written notice obligates Tenant for rent through the end of the required notice period regardless of actual move-out date. Rent $2,099/month base rent due on the 1st of each month. Rent is considered late after the 5th day of the month. Late fees are assessed as follows and are set forth in this written rental agreement pursuant to ARS 33-1368: Day 6: A late fee of $104.95 (5% of base rent) is assessed if rent has not been received in full. Day 15: An additional $75.00 is assessed if rent remains unpaid. Day 20: An additional $75.00 is assessed if rent remains unpaid. Maximum total late fee: $254.95 per month. Late fees apply to base rent only. Total monthly obligation is $2,269 ($2,099 base rent + $170 solar cost recovery fee). Returned Payment Fee Any payment returned by the bank for insufficient funds or any other reason will be subject to a $50.00 returned payment fee in addition to any applicable late fees. Landlord reserves the right to require all future payments be made via cashier's check or money order following a returned payment. Security Deposit $2,500 due at signing along with first month's rent. Deposit will be returned within 14 business days of termination of tenancy and delivery of possession with an itemized statement of deductions pursuant to ARS 33-1321. Application & Screening Requirements All applicants must meet the following minimum criteria to be considered for tenancy. Criteria are applied consistently to all applicants in accordance with the Fair Housing Act and Arizona Residential Landlord and Tenant Act. Income Requirements: Minimum gross monthly income of 3x the total monthly obligation ($6,807/month). Income must be verified through supporting documentation as follows: W-2 employees: three most recent consecutive pay stubs and most recent W-2 Self-employed applicants: two years of federal tax returns including Schedule C and six months of personal and business bank statements Government, disability, pension, VA, or Social Security income: official award letter or benefit statement showing monthly amount Bank statements may be requested for any applicant to verify reserves and financial stability Employment & Income Verification: Current verifiable employment or stable income source required. All income sources must be documented. Self-employment must be verified with tax returns as outlined above. Government or disability income accepted with official documentation. Rental History: Minimum 2 years of verifiable rental or ownership history required. Applicants must provide contact information for at least one prior landlord. Current and prior landlords will be contacted for references. No evictions within the past 5 years. Gaps in rental history must be explained in writing. Additional Requirements: All adult occupants aged 18 and older must submit a separate application and undergo full screening. Applications missing required documentation will not be processed until all items are received. Screening decisions are based solely on objective criteria applied consistently to all applicants in compliance with applicable Fair Housing laws. Solar Cost Recovery Property is equipped with a leased solar system under an agreement held by Landlord (Palmetto Solar, LLC dba LightReach, 25-year term effective July 11, 2024). LightReach retains full ownership of the solar system. Tenant is responsible for a monthly solar cost recovery fee equal to Landlord's exact LightReach monthly payment for the applicable lease period, currently $170/month. This fee is a direct pass-through of Landlord's actual solar lease obligation with no markup. The LightReach payment escalates annually at each lease renewal the solar cost recovery fee will adjust to match the then-current LightReach monthly payment. Tenant will receive 30 days written notice of any adjustment prior to lease renewal. A flat $25.00 administrative late fee applies if the solar cost recovery fee is not received by the 6th of the month. Landlord remains solely responsible for all obligations under the LightReach Solar Lease Agreement. Pets Maximum 2 dogs permitted. No weight restriction. $250/dog Pet Fee (nonrefundable). Pet rent is $50/month per dog due alongside base rent on the 1st of each month. Pet rent is subject to negotiation based on number of pets, size, and breed and the agreed upon amount will be documented in writing prior to lease signing. Tenant is liable for all pet-related damage beyond normal wear and tear. Tenant must provide proof of renter's insurance covering pet liability prior to move-in. Breed restrictions may apply per Landlord's homeowner's insurance policy. Tenant must disclose breed at application. No additional pets permitted without prior written Landlord approval. This property complies with all applicable Fair Housing laws including reasonable accommodation requirements for assistance animals. Utilities Tenant is responsible for all utilities including electric, gas, water/sewer, trash, and internet. Landlord covers HOA dues. Tenant must transfer all utility accounts into their name within 3 days of lease start. HOA Compliance Property is subject to HOA CC&Rs. Tenant must comply with all HOA rules including exterior aesthetics, trash can placement/schedule, and parking. Any HOA fines resulting from Tenant violation are the Tenant's financial responsibility. A copy of CC&Rs will be provided at lease signing. Maintenance & Repairs Tenant is responsible for routine maintenance (air filters, light bulbs, landscaping upkeep), reporting maintenance issues in writing within 24 hours of discovery, and any damage caused by Tenant, occupants, or pets. Landlord is responsible for habitability standards including working HVAC, plumbing, and electrical, as well as structural repairs not caused by Tenant pursuant to ARS 33-1324. Entry Notice Landlord will provide a minimum of 48 hours written notice before entry for any non-emergency purpose pursuant to ARS 33-1343. In case of emergency Landlord may enter without prior notice. Occupancy Only individuals listed on the lease are permitted occupants. Guests staying longer than 7 consecutive days or 14 days total in any 12-month period are considered unauthorized occupants and constitute a lease violation. Renter's Insurance Tenant is required to maintain renter's insurance with minimum $100,000 liability coverage for the duration of the lease. Proof of policy must be provided at lease signing and upon renewal. Alterations No modifications, painting, or alterations to the property without prior written Landlord approval. Unauthorized alterations will be remedied at Tenant's expense. Early Termination This lease may be terminated prior to the expiration date by Tenant upon 60 days written notice to Landlord and payment of a lease buyout fee equal to the greater of: (a) 25% of the remaining rent due for the lease term, or (b) one month's base rent. The lease buyout fee is due on or before the last day of residency. Upon receipt of written notice of early termination Landlord reserves the right to begin marketing the property and scheduling showings with a minimum of 48 hours written notice to Tenant. Tenant agrees to maintain the property in a clean and presentable condition during the showing period and to cooperate reasonably with scheduled showing times. Smoking/Vaping No smoking or vaping of any substance inside the property or garage. Outdoor smoking permitted only if Tenant assumes responsibility for any damage to landscaping or exterior surfaces. Governing Law This lease is governed by the Arizona Residential Landlord and Tenant Act (ARS Title 33, Chapter 10). Any provision found to be in violation of applicable Arizona law is unenforceable and severable from the remaining terms of this agreement.
