Renter is responsible for all utilities paid out via an average cost method. The payment will remain the same throughout the year. If utility costs are above $450 in a single month, the amount over is the responsibility of the tenant. Absolutely No smoking, No vaping, or use of E cigarettes in property. Additional Terms: Maintenance and Repairs Tenant agrees to maintain the Premises in a clean, safe, and sanitary condition. Any maintenance issues or repairs needed should be promptly reported to the Landlord. Failure to do so may result in the Tenant being held liable for damages caused by delayed reporting. Repairs to major systems (plumbing, electrical, HVAC) will be handled by the Landlord, except where damage is caused by Tenant negligence. Right of Entry Landlord reserves the right to enter the Premises with 24-hour notice for inspections, repairs, or showings to prospective tenants or buyers. In emergencies, Landlord may enter without notice to protect the property or Tenant. Grounds for Eviction The Landlord may initiate eviction proceedings for the following reasons: 1. Non-Payment of Rent: If rent is not paid within will apply. If rent remains unpaid by the 10th of the month, the Landlord may serve a three (3) day notice to pay rent or vacate the premises. Failure to comply within the notice period will result in eviction. 2. Violation of Lease Terms: Any breach of the lease terms, including but not limited to unauthorized pets, subletting, or illegal activities, may result in a three (3) day written notice to cure the violation or vacate the premises. If the Tenant fails to address the violation within the notice period, eviction proceedings may be initiated. 3. Damage to Property: If the Tenant causes signi Landlord reserves the right to serve a notice for immediate remedy or face eviction. 4. Abandonment of Property: If the Tenant abandons the property (de consecutive days of absence without notice and unpaid rent), the Landlord may reclaim the property without further notice, and the Tenant's possessions may be considered abandoned. 5. Illegal Activities: Any illegal activity carried out on the premises will result in immediate termination of the lease and possible eviction without notice. Eviction Process 1. Notice to Pay or Vacate: In cases of non-payment of rent, the Tenant will receive a three (3) day written notice to either pay the overdue rent and applicable late fees or vacate the premises. 2. Notice to Cure or Vacate: For other violations of the lease, the Tenant will receive a notice giving them three (3) days to correct the violation. Failure to comply will result in the 3. Legal Action: If the Tenant fails to comply with any of the notices, the Landlord may for eviction with the local court. The Tenant will be responsible for any legal fees or court costs incurred by the Landlord in connection with the eviction process. 4. Forcible Eviction: If the court grants an eviction, the Tenant may be forcibly removed from the premises by law enforcement if they do not vacate voluntarily. House Rules 1. No Unapproved Pets Tenants found with an unapproved animal on the property will be charged $500 extra monthly until pet is removed plus the actual cost of any damages. 2. Auto Repair No repair or remodeling of automobiles is allowed on the property. 3. No Smoking No smoking is allowed on or in the property by Tenant or guests. 4. No Waterbeds Waterbeds are prohibited. 5. Cleanliness Tenant agrees to maintain the home in a clean and orderly manner. 6. Paint & Holes Tenant agrees to not paint any walls, surfaces, or trim. NO PAINTING ALLOWED. Tenant also agrees to use provided hooks for hanging mirrors, painting, etc in order to not make large holes with screws or nails. All holes larger than the provided & approved hooks will be repaired at tenants expense. Abandonment of Property If the Tenant is absent from the Premises for more than 30 consecutive days without notifying the Landlord in writing, or if rent is unpaid and Tenant is unreachable, the Landlord reserves the right to deem the property abandoned and take possession. Subletting/Assignment Tenant shall not sublet or assign any interest in this Agreement or the Premises without the prior written consent of the Landlord. Unauthorized subletting will be considered a breach of this Agreement. Additionally, tenants may not allow guests to reside on the premises for more than seven (7) consecutive days or a total of fourteen (14) days within any six-month period without prior written approval from the Landlord. Any violation ofthis provision will be considered a breach of this Agreement and may result in eviction. Liquidated Damages In the event of the Tenant's breach or default, Tenant agrees to pay liquidated damages equal to one month's rent in addition to other obligations. Move-out and Cleaning Tenant agrees to clean the apartment and make it ready for the next tenant. If the Landlord or Manager needs to do any cleaning, it will be charged at a rate of $65 per hour. Tenants are responsible for paying for professional carpet cleaning, which will be scheduled by the Landlord. Additional Terms & Conditions 1. Liability Waiver The Landlord shall not be liable for any injuries or damages occurring on the Premises due to Tenant's negligence, misuse of the property, or failure to maintain safe living conditions. Tenant assumes all risks for personal injury or damage to their personal property resulting from their occupancy. 2. Damage Beyond Normal Wear and Tear Tenant is responsible for any damages to the Premises beyond normal wear and tear. This includes, but is not limited to, damage to walls, Tenant agrees to cover the cost of any necessary repairs or replacements, which will be assessed at the time of move-out or upon discovery of the damage. 3. Tenant Maintenance Obligations Tenant agrees to perform basic maintenance tasks, including but not limited to replacing light bulbs, maintaining cleanliness of appliances (such as cleaning oven and under refrigerator), and minor repairs. Tenant shall promptly report any required major repairs to the Landlord. 4. Mold Prevention Tenant agrees to maintain the Premises in a manner that prevents mold growth. Tenant is responsible for keeping the property properly ventilated and reporting any water leaks, moisture issues, or signs of mold to the Landlord immediately. Failure to do so may result in Tenant being held liable for damages. 5. Pest Control Tenant is responsible for pest control measures if pests are introduced or thrive due to the Tenant's behavior, such as improper disposal of garbage or unsanitary living conditions. Any costs associated with the removal of pests under these conditions will be charged to the Tenant. 6. Responsibility for Guests Tenant is fully responsible for the actions and behavior of any guests while they are on the Premises. This includes any damages caused by guests, disturbances to neighbors, or violations of any terms of this Agreement. 7. Noise and Nuisance Tenant agrees to refrain from excessive noise or disturbances that may interfere with the peaceful enjoyment of other tenants or neighbors. Any complaints of nuisance or disruptive behavior may be grounds for eviction. 8. Security Deposit Deductions Tenant understands and agrees that deductions from the security deposit may be made for any unpaid rent, cleaning fees, repair of damages beyond normal wear and tear, or replacement of missing items such as keys. An itemized list of deductions will be provided to the Tenant within 30 days of vacating the Premises. 9. Modifications & Alterations Tenant is not permitted to make any alterations, modifications or additions to the interior or exterior of the property without prior written consent from the Landlord. This includes, but is not limited to, building or installing any structures, other permanent or semi-permanent additions. Any unauthorized modifications construction may result in the termination of the lease and require the tenant to restore the property to its original condition at their own expense.
