Lease terms
Lease Duration: Minimum lease term of one (1) year. Rent: Monthly rent is $3,250, due on the first (1st) day of each month. First month's rent is due at lease signing. Security Deposit: A refundable security deposit of $3,250 (one month's rent) is required at signing. Deductions may be made for unpaid rent, damages beyond normal wear and tear, cleaning, repairs, or any other lease violations. Late Payments: Rent not received by the due date will be subject to any late fees permitted under Montana law. Returned Payments: Any returned check or failed electronic payment will be subject to applicable fees, and future rent payments may be required in certified funds. Utilities: Tenant is responsible for all utilities, including electricity, gas, water, sewer, trash, internet, cable, and any other utility services associated with the property. Pets: No pets are permitted on the property without the landlord's prior written approval. Smoking: Smoking, vaping, marijuana use, and the use of any illegal drugs are strictly prohibited inside the home, garage, and any enclosed structures on the property. Renters Insurance: Tenant must obtain and maintain renters insurance throughout the lease term with: Minimum $300,000 personal liability coverage. Minimum $100,000 personal property coverage. Proof of insurance must be provided before move-in and maintained throughout the lease term. The landlord shall be listed as an Additional Interested Party for policy notifications and cancellations. Occupancy: Only the individuals listed on the lease may occupy the property. No additional occupants or long-term guests are permitted without the landlord's prior written consent. Property Care: Tenant shall maintain the property in a clean, sanitary, and well-maintained condition. Any damage beyond normal wear and tear is the tenant's responsibility and may be deducted from the security deposit or billed directly. Landscaping: Tenant is responsible for maintaining the yard, including mowing, weed control, watering (if applicable), snow removal, and general exterior upkeep unless otherwise agreed in writing. HVAC Maintenance: Tenant shall replace HVAC air filters at least every 90 days or more frequently if required. Maintenance Reporting: Tenant agrees to promptly notify the landlord of any maintenance issues, including but not limited to plumbing leaks, roof leaks, appliance failures, heating or cooling issues, mold, water intrusion, or other conditions that could cause damage if left unreported. Alterations: No alterations, improvements, fixtures, painting, satellite dishes, or modifications may be made without the landlord's prior written consent. Subleasing/Assignment: Subleasing or assigning the lease is prohibited without the landlord's prior written consent. Liability: Tenant assumes responsibility for injuries or damages caused by the negligence or intentional acts of the tenant, occupants, or guests. Tenant's renters insurance shall be the primary source of coverage for such claims. Move-Out Condition: Upon vacating, the property must be returned in substantially the same condition as received, ordinary wear and tear excepted. Tenant shall have the property professionally cleaned prior to move-out and provide proof of cleaning upon request. Failure to do so may result in cleaning costs being deducted from the security deposit. Move-In/Move-Out Inspection: A move-in and move-out inspection, including photographs or video documentation, will be conducted and shall serve as documentation of the property's condition. Entry: Landlord may enter the property with at least 24 hours' notice for inspections, maintenance, repairs, appraisals, or showings, except in emergencies where immediate access is permitted. Early Termination: If the tenant wishes to terminate the lease before the expiration of the lease term, the tenant remains responsible for all lease obligations until the earlier of: The property is re-rented to a new tenant; or The lease term expires, subject to the landlord's obligation under applicable Montana law to make reasonable efforts to re-rent the property. The tenant shall also remain responsible for any unpaid rent, damages, cleaning costs, advertising costs, leasing costs, or other amounts permitted by law until the lease obligations have been satisfied. Compliance with Laws: Tenant agrees to comply with all applicable federal, state, and local laws, ordinances, HOA rules, and regulations while occupying the property.
