Lease terms

Terms and Conditions: Rent Payment: Tenant agrees to pay a monthly rent of $2650 on the first day of each month during the lease term. Rent shall be paid by automatic wire transfer to the landlord on the first of the month. A late fee of $100 will be assessed if rent is received after the 7th day of the month, and every 7 days thereafter. Homeowners Association (HOA) Rules: Tenant acknowledges and agrees to abide by all rules and regulations set forth by the Homeowners Association pertaining to the property. Tenant shall be responsible for any fines or penalties resulting from violations of HOA rules. Maintenance and Care: Tenant shall maintain the property in good condition throughout the lease term. Tenant is responsible for promptly reporting any maintenance issues or repairs needed to the Landlord. Routine maintenance tasks such as changing HVAC filters, maintaining the yard, and minor repairs shall be the responsibility of the Tenant. Any minor repair of $150 or less will be the responsibility of the tenant to repair. Lawn Service: (optional) Landlord and Tenant agree to split the cost of a lawn service. Landlord shall cover 50% of the total cost, and Tenant shall cover the remaining 50%. The lawn service will be arranged and coordinated by Landlord. Security Deposit: Tenant has provided a security deposit of $3500, which shall be held by the Landlord to cover any damages beyond normal wear and tear. Lease Term: The lease term shall be for 12 months, commencing on [Start Date] and ending on [End Date]. Renewal and Termination: At the end of the lease term, the Lease shall automatically renew on a month-to-month basis unless terminated by either party with a written notice of at least 60 days. Utilities: Tenant is responsible for all utilities, including electricity, gas, water, and any applicable services such as internet and cable TV. Move-Out Painting: Upon the expiration or termination of this lease agreement, Tenant agrees to restore the interior walls of the premises to their original condition, excluding normal wear and tear. Tenant shall be responsible for repairing any nail holes, dents, or damage caused by the hanging of artwork, shelves, or other decorative items. Tenant may be required to repaint the walls with a neutral color acceptable to the Landlord. The Landlord reserves the right to deduct any necessary painting or repair costs from the security deposit if the Tenant fails to fulfill this obligation. Right of Entry: Landlord or its agents shall have the right to enter the premises for inspection, maintenance, repairs, or any other reasonable purpose, with at least 24 hours' notice to the Tenant. No Smoking Inside the House: Tenant acknowledges and agrees that smoking is prohibited within the interior of the premises. This includes any form of smoking, such as tobacco, electronic cigarettes, and vaping devices, within the confines of the house. Tenant understands that any evidence of indoor smoking will constitute a breach of this lease agreement and may result in penalties, additional cleaning expenses. Tenant may be permitted to keep cats and small dogs on the property subject to the following terms and conditions: Pet Responsibility: Tenant acknowledges that any odors, damages, or alterations caused by the presence of pets are the sole responsibility of the Tenant. This includes, but is not limited to, repairing any damage to the property caused by the pets and ensuring that the premises are free from any unpleasant odors attributed to the pets. Tenant shall take all necessary measures to prevent any disturbances to neighbors or damage to the property due to the pets. Move-Out Remediation: Upon the expiration or termination of this lease agreement, Tenant agrees to remediate any pet-related odors or damages to the property caused by the pets. Tenant shall bear the costs associated with cleaning, repairing, or restoring the property to its original condition, excluding normal wear and tear, resulting from the pets. Additional Security Deposit: Tenant shall provide an additional security deposit of $1000 specifically designated for pet-related damages. This deposit is in addition to the standard security deposit and will be held to cover any costs associated with pet-related damages or remediation. The disposition of the pet deposit will be subject to the same terms and conditions as the standard security deposit. Damage Due to Negligence: Tenant Responsibility Tenant acknowledges and agrees that any damage to the property resulting from negligence, misuse, or improper care shall be the sole responsibility of the Tenant. Such damages will not be considered normal wear and tear and shall be repaired at the cost of the Tenant. Examples of damage due to negligence include, but are not limited to: Accidental Spills: Any spills on flooring, carpets, or countertops that are not promptly cleaned and result in permanent staining or damage. Wall Damage: Holes, dents, or scratches in walls caused by furniture moving, hanging items without proper support, or rough handling. Appliance and Fixture Misuse: Damage to appliances or fixtures due to improper use, neglect, or failure to follow manufacturer's instructions, including clogs in plumbing fixtures. Window Treatments: Tears, burns, or stains on curtains, blinds, or drapes due to negligence or misuse. Pet-Related Damage: Damages caused by pets beyond normal wear and tear, including scratches on doors, walls, or floors, and damage to screens or window frames. Children's Activities: Damage caused by children's activities, such as drawings or markings on walls, doors, or other surfaces, broken windows due to play, or damage to fixtures and furniture. Exterior Property Damage: Damage to the exterior of the property, landscaping, or outdoor structures caused by neglect, improper use, or failure to maintain. Fire Prevention: Failure to exercise proper fire safety precautions resulting in damage to the property or surrounding areas. Tenant's understanding and acknowledgment of this Damage Due to Negligence section signifies their commitment to take necessary precautions and exercise responsible behavior to prevent damages that may occur as a result of negligence. Owner's Responsibilities The Owner acknowledges and agrees to fulfill the following responsibilities related to the property during the term of this lease agreement: Property Taxes and Homeowner's Association (HOA) Dues: The Owner shall be responsible for the payment of property taxes and any applicable HOA dues. Tenant is not liable for these expenses. Mortgage Payments: The Owner shall ensure that all mortgage payments related to the property are made in a timely manner and shall provide proof of payment to the Tenant upon request. Structural and Major Repairs: The Owner shall bear the responsibility for conducting and financing major repairs and maintenance that affect the structural integrity, safety, and habitability of the property. This includes repairs to the roof, foundation, plumbing, electrical systems, heating, ventilation, and air conditioning systems. Property Insurance: The Owner shall maintain adequate property insurance coverage throughout the lease term to protect against damages and liabilities related to the property. Compliance with Legal Regulations: The Owner shall ensure that the property complies with all local, state, and federal laws, codes, and regulations related to housing, safety, and habitability. Common Area Maintenance (if applicable): If the property is part of a condominium, townhouse, or community with common areas, the Owner shall be responsible for the maintenance and repair of these common areas. It is understood that the Owner's responsibilities as outlined in this section are crucial to maintaining the property's condition, safety, and value. Tenant's rights to a well-maintained and habitable property are contingent upon the Owner's fulfillment of these responsibilities.
