we own mobilehome which is in a mh park we pay $200 a month for the lot rent alone. we have had issues regarding the property in which it sets and we pay rent for. What are a landlords responsablities vs our rights in this kind of situaton?

We purchased the mobilehome with our familys help for my family because I am disabled and my husband lost his job because of a severe heart condition. He has since been dtermined disabled and our household income is that only of social security disablity. we have two children the oldest is 19 and is in collage and the youngest is 14 and lives at home. we are living outside the school dist in which our youngest attendes school whch is also inside a different county. we have had ongoing problems with the actual prperty which our home sits and pay 200.00 lot rent and the landlord/park owner has not and will not accept that they have any responsability regarding the issues we have had starting within the first 6 months after the home was purchased and paid for in which they were then the owners. we have had water in under and around our home since march 2007 the home has been in the same location since ealy 1980's we have no water leakage from the water lines but they say the water and sewer lines to and from the home are our responsability. they provide no sevices and no utility/garbage or any other maintaince to us. What are a teanants rights in this situation and is there any kind of housing assistance available to us given our income situation.The drinking water and sewage is not included in the lot rent and isn't fit to drink, we pay the city of lexington for those two services along with garbage service for an additional $65 a month along with lawn maint. of $45.00 $310. for absolutly nothing in return.

I have lived in a mobile home park before myself. As far as lot rental, unless it states otherwise in your lease, all they are responsible for is below the ground when it comes to the water and sewage. As far as the water quality, that is the city's responsibility. If you are having a problem with these things your best bet is to find a mobile home moving company and move your home over to another park or find a piece of property to put it on.

There is a place called mobile home association I would advise contacting them. http://www.mhoaa.us/ They should be able to help you or directing you to someone who can help you. I would also get an inspection of the mobile home as soon as I could I am not sure what it costs to do this when my father did it he charged 500 an hour . they will tell you what is wrong and take pictures to show what is going on. The sewer lines are not your responsibilty there actually the parks responsibility this is why you pay the lot rent. they actually own the land your home is on you actually only own the home not the land so you can move the mobile home at any point and time to a diffrent peice of land. http://www.molaofmi.org/ This site should also help you to understand exactly where to start looking http://www.in.gov/judiciary/opinions/pdf/07310802ebb.pdf the last link is a court case I think might help you.
