he recently came to talk to us and said he was loosing the house but until then he was lowering our rent to $500 to cover for garbage/water/sewer bill and homeinsurance
Yes, it's legal. The fact that he is not honoring his mortgage agreement with his bank does not give you the right to not honor your lease agreement with him.
What about if the landlord actually lost the house and still collected rent for 6mos when his name was no longer on the house? (the bank took possession)
Hi Luis, I am a Realtor in Stockton, don't kknow what you are paying for rent or what you credit or job history is but have you considered buying? As Neil said you are still legally obligated to abide by the contract (rental agreement)you have with your landlord even though he is not honoring his agreement with his mortgage holder.
If he is NOT paying his mortgage, you are not obligated to pay rent. You may also qualify for CASH for KEYS. My sister has gone through this twice now. The first time, her landlord had NOT been paying the mortgage for over 6 months. DO NOT PAY YOUR LANDLORD 1 cent more. CAll the housingauthority and get information.
