Our landlord is not paying association dues. The association levied our rent check. Now the landlord is not paying the mortgage. Are they in breach of contract on our lease?

We're wondering whether we are free to relocate or not.

It seems to me that there would not be anything in your contract with the landlord that states that he must pay his association bills or his mortgage. Your contract states that you must pay your rent to the landlord. Now the association and or the landlord's mortgagee can deal with the homeowner as they see fit. If you are faithfully paying your rent to the landlord I can understand how uncertain you must be feeling not knowing what stage of foreclosure your landlord is in. You must speak to your landlord to resolve. If you cannot get anywhere with your landlord seek out the advise of an attorney.

My family had this problem after they bought our family home in 1955. He and our neighbor agreed to plant rose bushes where the kids would come into our yard. My Dad had a terrific green thumb and kept those roses beautiful for many years; no more cut-throughs either. Those rose bushes were still there when they sold the house in 1995. I noticed recently that the rose bushes were gone. Perhaps the kids don't cut through any more. (Note that we had no problems with animals urinating there and destroying the bushes; Dad did keep up a fight against Japanese Beetles there. (This answer was to the question about kids cutting through yards. This is a safe and non-cynical solution that our neighbors loved. When my parents packed up to move to a retirement community, they were told their house and yard were the best kept in the neighborhood. My parents had no idea they were held in such regard. That was great. We recently lost my folks at ages 88 (Mother) and 90 (Dad), but I remember them and the rose bushes well.
